NS-2112 <br /> <br />l <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA ADDING <br />SECTION 2-618 TO THE SANTA ANA MUNICIPAL CODE <br />TO DEFER PAYMENT OF CITY FEES AND CHARGES BY <br />THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY <br />OF SANTA ANA <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br />SECTION 1: That the Santa Ana Municipal Code is hereby <br />amended by adding a section, to be numbered 2-618, which said <br />section reads as follows: <br /> <br />Sec. 2-618. City fee payment deferral. <br /> <br />(a) To the extent that the community Redevelopment <br />Agency of the city of Santa Ana has an obligation to pay city <br />fees or charges (including development fees and administrative <br />cost fees) for construction, demolition, or building site <br />preparation work, the payment of such fees by the said <br />redevelopment agency, or by contractors performing such work, <br />or by the subcontractors of such contractors, shall be <br />deferred until such time as the city council may demand the <br />payment thereof. The said redevelopment agency shall be <br />responsible for the eventual payment of all fees deferred <br />pursuant to this section, including those which would <br />otherwise have been paid by its contractors or their <br />subcontractors. The said redevelopment agency's obligations <br />under this section shall constitute an indebtedness of the <br />said redevelopment agency to the City of Santa Ana. <br /> <br />(b) For purposes of this section, the said redevelopment <br />agency shall be deemed to have the obligation to pay city fees <br />and charges for construction, demolition or site preparation <br />work on private property only to the extent that the said <br />redevelopment agency has assumed such obligation in an <br />agreement with a private developer for the development of such <br />property. <br /> <br />SECTION 2: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council of <br />the city of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that anyone or <br /> <br />1 <br />
