Specific Development Plan No. 40 is hereby amended to <br />exclude the area shown as Areas A and B on Exhibit 9. <br /> <br />4. Amended sectional District Maps numbers 8-5-9, 17-5-9, <br />6-5-9, 7-5-9, 18-5-9, 19-5-9, 12-5-10, 13-5-10, 2-5-10, 11-5-10, <br />14-5-10, 23-5-10, 3-5-10, and 10-5-10 showing the above described <br />changes in use district designations are hereby approved. <br /> <br />5. Any real property which on or before the date of adoption <br />of this Ordinance meets either or both of the following conditions <br />shall, at the option of the owner of the property, be subject to <br />the use district regulations which applied to such property <br />immediately prior to this Ordinance. <br /> <br />(a) Development was approved for the property through the <br />approval of a conditional use permit or a tentative <br />subdivision map. <br /> <br />(b) Application for a permit for such development has been <br />filed pursuant to Chapter 3 of the Building Code; <br /> <br />provided, however, this section shall cease to apply to any <br />development for which a conditional use permit or tentative map was <br />approved if the conditional use permit or tentative map expires or <br />is revoked for good cause, or to any development for which a <br />building permit application expires without issuance of the <br /> <br />2 <br />
