ORDINANCE NS-2165 <br />Page ~ ~8 5 <br /> <br /> considered and state the hearing officer's findings, <br /> conclusions and recommendations. The report shall also contain <br /> a proposed decision in the matter. All such reports filed with <br /> the clerk shall be matters of public record. A copy of each <br /> such report of proposed decision shall be mailed by certified <br /> mail to the applicant/appellant within five (5) days of <br /> receipt by the clerk and a further copy shall be sent to the <br /> city department, board or commission most directly concerned <br /> with the subject of the report. <br /> <br /> SECTION 6: That section 3-8 of the Santa Ana Municipal Code <br />is hereby amended to read as follows: <br /> <br /> Sec. 3-8. Consideration of hearing officer's report by <br /> council notice. <br /> <br /> The clerk of the council shall place the hearing <br /> officer's report on the agenda for the next regular meeting <br /> which occurs not less than ten (10) days after the report is <br /> mailed and shall notify the applicant/appe}lant of the date of <br /> such meeting at least ten (10) days prior to the meeting <br /> unless the applicant/appellant stipulates to a shorter notice <br /> period. <br /> <br /> SECTION 7: That section 3-11 of the Santa Ana Municipal Code <br />is hereby amended to read as follows: <br /> <br />Sec. 3-11. Hearings to which this chapter shall not apply. <br /> <br />The provisions of this chapter shall not apply to: <br />(1) Hearings to consider the master plan or the general plan. <br /> <br /> (2) Hearing to determine whether public convenience and <br /> necessity require acquisition of property for public use. <br /> <br />(3) Hearings to consider parcel maps. <br /> <br />(4) Hearings to review or consider on appeal any action of <br /> the planning commission or zoning administrator. <br /> <br /> SECTION 8: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council of <br />the City of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, <br />phrase, or portion thereof irrespective of the fact that any one or <br />more sections, subsections, sentences, clauses, phrases, or <br />portions be declared invalid or unconstitutional. <br /> <br /> <br />
