ORDINANCE NO. NS-2172 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />ADDING SECTIONS 34-4 AND 41-780 TO THE <br />SANTA ANA MUNICIPAL CODE TO REQUIRE THAT <br />ALL APPLICABLE ZONING, SUBDIVISION, <br />CONDITIONAL USE PERMIT, AND VARIANCE <br />DECIS/~0NS BE CONSISTENT WITH THE COUNTY <br />HAZARDOUS WASTE MANAGEMENT PLAN <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />FOLLOWS: <br /> <br /> SECTION 1: That the Santa Ana Municipal Code <br />amended by adding a section, to be numbered 41-780, <br />section reads as follows: <br /> <br />Sec. 34-4. <br /> <br />Consistenoy with the county <br />Management Plan. <br /> <br />Hazardous <br /> <br /> ORDAIN AS <br /> <br />is hereby <br />which said <br /> <br /> Waste <br /> <br /> Ail applicable subdivision decisions shall be consistent with <br />the portions of the Orange County Hazardous Waste Management Plan <br />which identify general areas or siting criteria for hazardous waste <br />facilities. <br /> <br /> SECTION 2: That ~he Santa Ana Municipal Code is hereby <br />amended by adding a section, to be numbered 41-780, which said <br />section reads as follows: <br /> <br />Sec. 41-780. <br /> <br />Consistency with the County Hazardous Waste <br />Management Plan. <br /> <br /> Ail applicable zoning, conditional use permit, and variance <br />decisions shall be consistent with the portions of the Orange <br />County Hazardous Waste Management Plan which identify general areas <br />or siting criteria for hazardous waste facilities. <br /> <br /> SECTION 3: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The city Council of <br />the city of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one or <br />more sections, subsections, sentences, clauses, phrases, or <br />portions be declared invalid or unconstitutional. <br /> <br />SECTION 4: Neither the adoption of this ordinance nor the <br /> <br />1 <br /> <br /> <br />
