401 <br /> <br />ORDINANCE NO. NS-2179 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />AUTHORIZING THE DOWNTOWN DEVELOPMENT <br />MANAGER TO ISSUE CITATIONS FOR <br />VIOLATIONS OF CERTAIN MUNICIPAL CODE <br />PROVISIONS AND TO ISSUE NOTICES OF <br />PARKING VIOLATIONS <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> SECTION 1: That the Santa Ana Municipal Code is hereby <br />amended by adding a section, to be numbered 1-18.4, which said <br />section reads as follows: <br /> <br />Seo. 1-18.4. <br /> <br />Downtown development manager authority to issue <br />oitations. <br /> <br /> The downtown development manager has the duty to enforce the <br />following provisions of this Code: sections 10-26, 10-27, 10-100, <br />10-141, 10-142, 16-1 through 16-6, 26-6, and 41-1020 through 41- <br />1040. The downtown development manager is authorized to arrest <br />persons without a warrant whenever they have reasonable cause to <br />believe that the person to be arrested has committed a violation of <br />said provisions in their presence. In any case in which a person <br />is arrested pursuant to this section, and the person arrested does <br />not demand to be taken before a magistrate, the downtown <br />development manager shall prepare a written notice to appear and <br />release the person on his or her promise to appear as prescribed by <br />Chapter 5C, Title III, Part 2 of the Penal Code of the State of <br />California (commencing with Section 853.5). <br /> <br /> SECTION 2: The downtown development manager is hereby <br />authorized to enforce parking laws and regulations set forth in the <br />Vehicle Code of the State of California and the Santa Ana Municipal <br />Code through the issuance of notices of parking violations in <br />accordance with Article 3 of Chapter 1 of Division 17 of the said <br />Vehicle Code. <br /> <br /> SECTION 3: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council of <br />the city of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one or <br />more sections, subsections, sentences, clauses, phrases, or <br />portions be declared invalid or unconstitutional. <br /> <br /> <br />
