NS- 2224 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />ADDING SECTION 8-10 TO THE SANTA ANA <br />MUNICIPAL CODE TO REQUIRE ON ON-SITE <br />CARETAKERS FOR LARGE APARTMENT HOUSES <br />AND HOTELS <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> SECTION 1: That the Santa Ana Municipal Code is hereby <br />amended by adding a section, to be numbered 8-10, which said <br />section reads as follows: <br /> <br />Sec. 8-ZO. <br /> <br />On-site caretakers for large apartment buildings <br />and hotels. <br /> <br /> A manager, janitor, housekeeper, or other responsible person <br />shall reside upon the premises and shall have charge of every <br />apartment house in which there are 16 or more apartments, and of <br />every hotel in which there are 12 or more guest rooms, in the event <br />that the owner of any such apartment house or hotel does not reside <br />upon said premises. Only one caretaker would be required for all <br />structures under one ownership and on one contiguous parcel of <br />land. If the owner does not reside upon the premises of any <br />apartment house in which there are more than four but less than 16 <br />apartments, a notice stating his name and address, or the name and <br />address of his agent in charge of the apartment house, shall be <br />posted in a conspicuous place on the premises. <br /> <br /> SECTION 2: Section 8-10 of the Santa Ana Municipal Code, as <br />added by this ordinance, corresponds to a regulation of the <br />Department of Housing and Community Development of the State of <br />California: specifically, Section 42 of Article 5 of Subchapter 1 <br />of Chapter 1 of Division 1 of Title 25 of the California Code of <br />Regulations. It is adopted by the City of Santa Ana pursuant to <br />the authority set forth in 17958 of the Health and Safety Code of <br />the State of California. Pursuant to section 17964 of the said <br />Health and Safety Code those officers and employees of the Planning <br />and Building Agency specified in section 1-18.1 of the Santa Ana <br />Municipal Code are charged with the enforcement of said Section 8- <br />10. <br /> <br /> SECTION 3: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the validity <br />of the remaining portions of this ordinance.
