217 <br /> <br />REL: 8/9/94 <br /> <br />ORDINANCE NO. NS-?~I <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />AMENDING ORDINANCE NO. NS-2039 WHICH <br />APPROVED AND ADOPTED THE REDEVELOPMENT <br />PLAN FOR THE BRISTOL CORRIDOR REDEVELOP- <br />MENT PROJECT <br /> <br /> WHEREAS, on December 4, 1989, the city Council of the City of <br />Santa Ana adopted Ordinance No. NS-2039, approving and adopting the <br />Redevelopment Plan for the Bristol Corridor Redevelopment Project <br />Area; and <br /> <br /> WHEREAS, in an opinion dated January 29, 1993, the Court of <br />Appeal of the State of California, Fourth Appellate District, <br />Division Three, determined that the adoption of the Redevelopment <br />Plan for the Bristol Corridor Redevelopment Project Area was <br />defective for two reasons: <br /> <br />(a) <br /> <br />(b) <br /> <br />The City of Santa Ana and the Community Redevelopment <br />Agency of the city of Santa Ana failed to identify the <br />dwellings that are or are being provided for the dis- <br />placed residents in accord with section 33367, subdivi- <br />sion (d) (8) of the Health and Safety Code; and <br /> <br />The City of Santa Ana and the Community Redevelopment <br />Agency of the City of Santa Ana failed to show why non- <br />blighted property which will not be affected by the <br />widening of Bristol Street must be included in the <br />project area; and <br /> <br /> WHEREAS, the City Council previously adopted Ordinance No. NS- <br />2202 in order to show why non-blighted non-Bristol property must be <br />included in the project area and identify the replacement dwellings <br />that are or are being provided the displaced residents, but such <br />showing and identification were again deemed inadequate by the <br />Superior Court of the County of Orange; and <br /> <br /> WHEREAS, the Executive Director of the City's Community <br />Development Agency has caused a report to be prepared to show in <br />more detail why non-blighted non-Bristol property must be included <br />in the project area and identify the replacement dwellings that are <br />or are being provided the displaced residents; and <br /> <br /> WHEREAS, the city Council, through its adoption of this <br />ordinance, desires to show why non-blighted non-Bristol property <br />must be included in the project area and identify the replacement <br />dwellings that are or are being provided the displaced residents, <br />in order that the Redevelopment Plan for the Bristol Corridor <br />Redevelopment Project Area may go forward, in accordance with the <br /> <br />.% <br /> <br /> <br />
