NS- 2247 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />ADDING SECTION 2-705.5 TO THE SANTA ANA <br />MUNICIPAL CODE TO AUTHORIZE THE CHIEF OF <br />POLICE TO DONATE UNCLAIMED BICYCLES AND <br />TOYS TO GOVERNMENTAL AND PRIVATE NON- <br />PROFIT ORGANIZATIONS FOR THE PREVENTION <br />OF JUVENILE DELINQUENCY <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> SECTION 1: That the Santa Ana Municipal Code <br />amended by adding a section, to be numbered 2-705.5, <br />section reads as follows: <br /> <br />is hereby <br />which said <br /> <br />8eo. 2-705.5. Donations of unclaimed bicycles and toys for the <br /> prevention of juvenile delinquency. <br /> <br /> Any bicycles or toys, or both, in the possession of the police <br />department which have been unclaimed for a period of at least 60 <br />days may, instead of being sold at public auction to the highest <br />bidder pursuant to section 2-705, be turned over by the chief of <br />police to the probation officer, to the welfare department of the <br />county, or to any charitable or nonprofit organization which is <br />authorized under its article of incorporation to participate in a <br />program or activity designed to prevent juvenile delinquency and <br />which is exempt from income taxation under federal or state law, or <br />both, for use in any program or activity designed to prevent <br />juvenile delinquency. <br /> <br /> SECTION : If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council of <br />the City of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one or <br />more sections, subsections, sentences, clauses, phrases, or <br />portions be declared invalid or unconstitutional. <br /> <br /> SECTION : Neither the adoption of this ordinance nor the <br />repeal hereby of any ordinance shall in any manner affect the <br />prosecution for violation of ordinances, which violations were <br />committed prior to the effective date hereof, nor be construed as <br />affecting any of the provisions of such ordinance relating to the <br />collection of any such license or penalty or the penal provision <br />applicable to any violation thereof, nor to affect the validity of <br /> <br /> <br />
