133 <br />ORDINANCE NS-2273 <br />Page 19 <br /> <br />the scope of this article, or is found to be structurally capable <br />of resisting minimum seismic forces required by this article, the <br />building official shall file with theoffice of the county recorder <br />a certificate terminating the status of the subject building as <br />being classified within the scope of Santa Ana Municipal Code, <br />Article XI of Chapter 8, "Earthquake Hazard Reduction in Existing <br />Buildings." <br /> <br /> (c) Appeal from order. Any owner or tenant of the building may <br />appeal the building official's initial order and determination so <br />long as such appeal is filed within one hundred and eighty (180) <br />days of the service of the aforesaid order. The filing and form of <br />appeal, the processing of the appeal, the scheduling and noticing <br />of said appeal for hearing, the effect of a failure to appeal, the <br />scope of hearing of said appeal, and the procedure for conducting <br />the hearing of any such appeal, shall be governed by the provisions <br />of Chapters 5 and 6 of the Uniform Code for the Abatement of <br />Dangerous Buildings, as said Uniform Code is adopted by reference <br />pursuant to the provisions of Article IX of Chapter 8 of this Code. <br />In case of any inconsistency between the provisions of this <br />subsection and the provisions of Chapters 5 and 6 of the Uniform <br />Code for the Abatement of Dangerous Buildings, the provisions of <br />this subsection shall control. <br /> <br /> (d) Enforcement. If the owner or tenant fails to comply with <br />any order issued by the building official within any of the time <br />limits set forth in subsection (a) of this section, or with any <br />order or decision rendered by the planning commission, the building <br />shall be deemed to constitute a dangerous building and the <br />provisions of Chapters 7, 8 and 9 of the Uniform Code for the <br />Abatement of Dangerous Buildings, as said uniform code is adopted <br />by reference in Article IX of Chapter 8 of this Code, shall be <br />applicable. Any person found guilty of a misdemeanor shall be <br />punished in the manner set forth in section 1-8 of this Code. <br /> <br /> SECTION 49: That sections 8-2004.1, 8-2004.5, 8-2005, 8-2006, <br />and 8-2007 of the Santa Ana Municipal Code are hereby repealed. <br /> <br /> SECTION 50: That section 8-2500 of the Santa Ana Municipal <br />Code is hereby amended to read as follows: <br /> <br />Sec. 8-2500. Adoption by reference. <br /> <br /> There is adopted by the city that certain code known as the <br />International Association of Plumbing and Mechanical Officials <br />Uniform Solar Energy Code, 1994 Edition, save and except that <br />portion entitled "Part I, Administrative."
