ORDINANCE NO. NS- 2289 AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AND ADOPTING A FIRST AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE SANTA ANA INTER CITY COMMUTER STATION REDEVELOPMENT PLAN WHEREAS, the city Council of the City of Santa Ana (the "city Council") adopted Ordinance No. NS-1636 on July 6, 1982, approving and adopting the Redevelopment Plan for the Santa Ana Inter City Commuter Station Redevelopment Project Area (the "Redevelopment Plan" and the "Project Area"); and WHEREAS, after due notice, the City Council and the Santa Ana Redevelopment and Housing Commission ("Commission"), performing functions of the Community Redevelopment Agency of the City of Santa Ana ("Agency") pursuant to Resolution No. 91-102 of this Council, held a joint public hearing to consider the approval and adoption of a proposed first amendment of the Redevelopment Plan to extend the time limit for the commencement of eminent domain proceedings to acquire property within the Project Area (the "Amendment"); and WHEREAS, the Commission, following the conclusion of said joint public hearing has recommended that the Amendment be approved and adopted; and WHEREAS, the City Council has considered and evaluated the Amendment and the Environmental Impact Report prepared for the Amendment, and has provided an opportunity for all persons to be heard and has received and considered all evidence and testimony presented for and against any and all aspects of the Amendment, including environmental impacts; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: The Amendment is hereby approved and adopted. SECTION 2: Based on substantial evidence in the record, the City Council hereby finds and determines that the condemnation of real property continues to be necessary to the execution of the Redevelopment Plan. SECTION 3: Ail findings and determinations contained in Ordinance No. NS-1636 remain in full force and effect. 281
