238 <br /> <br />ORDINANCE NO. NS- 2 3 6 4 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROViNG AN AMENDMENT TO THE <br />DEVELOPMENT AGREEMENT BETWEEN THE CITY OF <br />SANTA ANA AND DISCOVERY SCIENCE CENTER. <br /> <br /> WHEREAS, this Council adopted Ordinance No. NS-2320, on May 5, 1997, adopting a <br />Development Agreement ("Agreement") between the Discovery Science Center, a California Non- <br />profit Corporation (Developer) and the City of Santa Ana ("City") to develop a science museum <br />and discovery center (the "Project") on that certain property generally located on the west side of <br />Main Street, north of the I-5 Santa Ana Freeway right of way and south of Santiago Creek (the <br />"Property"); and, <br /> <br /> WHEREAS, the parties to the Agreement now desire to amend said agreement to reflect a <br />change in the permitted land uses applicable to the Project; and <br /> <br /> WHEREAS, this Council, prior to taking action on this ordinance, has held a duly noticed <br />public hearing, on said Amendment to the Development Agreement. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />ORDAIN AS FOLLOWS: <br /> <br /> 1. That certain Amendment to the Development Agreement between the City of Santa Ana <br />and Discovery Science Center, dated July 20, 1998, is hereby approved, and the Mayor is <br />authorized to execute said Amendment on behalf of the City of Santa Ana following its execution <br />by Developer, and the Clerk of the Council to attest to the same. <br /> <br /> 2. The Clerk of the Council is directed to cause a copy of the Amendment to the <br />Development Agreement to be recorded in the official records of Orange County, California, within <br />ten days following its effective date. As useqherein effective date means the date thirty days after <br />the date of adoption of this ordinance. <br /> <br /> <br />
