4O5 <br /> <br /> d. Notice of Determination. Notice of the decision-maker's <br />decision and its written findings shall be mailed by first-class mail, postage <br />prepaid and including a copy of an affidavit or certificate of mailing, to the <br />applicant and any interested person. Such notice shall include direct notice that <br />the time within which judicial review of the decision must be sought is <br />governed by California Code of Civil Procedure section 1094.6. <br /> <br />SECTION 10. <br /> <br /> Repeal of Emergency Ordinance. Ordinance No. NS-2372 of the City, an <br />emergency ordinance regulating adult entertainment businesses, shall be repealed as of <br />the effective date of this Ordinance; provided, however, that should enforcement of <br />this Ordinance be enjoined by a Court of competent jurisdiction prior to its effective <br />date, then Ordinance No. NS-2372 shall remain in full force and effect. <br /> <br />SECTION 11. <br /> <br /> Severability. If any section, subsection, sentence, clause, phrase or <br />word of this Ordinance is for any reason held to be invalid by a court of competent <br />jurisdiction, such decision shall not affect the validity of the remaining portions of this <br />Ordinance. The city council hereby declares that it would have passed and adopted <br />this Ordinance, and each and all provisions hereof, irrespective of the fact that one or <br />more provisions may be declared invalid. <br /> <br />ADOPTED this 7~ch day of December, 1998. <br /> <br />ATTEST: <br /> <br />Mayor <br /> <br />32 <br /> <br /> <br />
