426 <br /> <br />Ordinance No. NS-2378 <br /> <br />AN EMERGENCY ORDINANCE OF THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA EXTENDING THE <br />MORITORIUM ON THE PROHIBITION ON THE DISPLAY <br />OF ANY NEW NON-AERIAL BALLOON SIGN <br /> <br /> The City Council of the City of Santa Aha finds, determines <br />and declares as follows: <br /> <br /> 1. Provisions of Article XI of Chapter 41 of Santa <br />Ana Municipal Code ("Code") that regulate special event signs <br />and banners, including but not limited to sections 41-861(4) and <br />41-871(4) of the Code, need review, study and possible revision <br />in order to respond to recent concerns relating to visual <br />blight. Because of their age, such provisions fail to fully <br />take into account the potential impacts of such signage, <br />including non-aerial balloons signs, on the image of the City <br />and fail to address the needs of the City and its residents <br />today and in the future. For this reason, on November 16, 1998, <br />the City Council adopted Ordinance NS-2375 as an emergency <br />ordinance ("emergency ordinance"), which by its own terms <br />expires 45 days from the date of its adoption unless otherwise <br />extended. <br /> <br /> 2. Given these concerns, the Planning Commission, at its <br />regular meeting of December 14, 1998, requested that a review <br />be undertaken of the current provision of Article XI of Chapter <br />41 of the Code as it relates to all special events signage, <br />including banners and non-aerial balloons. The Planning <br />Commission has expressed concerns that temporary signage <br />currently permitted under the Code contributes to visual blight <br />in the City. <br /> <br /> 3. The Planning Commission has also expressed concern <br />that the current regulations reinforce a perception in the <br />business community that the City does not regulate temporary <br />signage. Within the last two years the Community Preservation <br />Division has issued over 1,600 warning notices to businesses <br />with illegal temporary signage. <br /> <br /> 4. Of particular concern are roof mounted, non-aerial <br />balloon signs, which can be visible for several blocks and are <br />especially intrusive when installed on a building immediately <br />adjacent to a single family neighborhood.
