NS-2435 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AMENDING THE HOURS OF <br />OPERATION APPLICABLE TO THE RETAIL USES <br />IN SPECIFIC DEVELOPMENT NO. 39 (ZOA 00-04) <br /> <br /> WHEREAS, this Council, by its Ordinance No. NS-1856, adopted July 7, 1986, <br />rezoned property located at the Northwest corner of First Street and Broadway, more <br />specifically described in said ordinance, to Specific Development Plan No. 39 for such <br />property; and <br /> <br /> WHEREAS, it is now desired to allow a change in the hours of operation for the <br />retail uses in SD No. 39. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />ORDAIN that Specific Development Plan No. 39, Section 6, "Operational Standards," <br />subsection A.1 .(d), is hereby amended to read as follows: <br /> <br />d) Retail and service uses, as defined by Chapter 41 of the Santa Ana <br />Municipal Code, hours of operation may only occur between the hours of 6 <br />a.m. and 7 p.m. Restaurant and arts-related uses may operate between <br />the hours of 6 a.m. and 11 p.m. As used herein, arts-related uses shall <br />mean occupancy of the Premises with one or more uses which are <br />predominately related to the sale, display, teaching, studio or production <br />of the performing or visual arts, including, but not limited to, painting, <br />sculpture, ceramics, glass works, music, graphics, videography and/or <br />photography. <br /> <br />ADOPTED this 17th day of July ,2000. <br /> <br />ATTEST: <br /> <br />rwayor <br /> <br />Ordinance No. NS-2435 <br /> Page 1 of 2 <br /> <br /> <br />
