155 <br /> <br /> Whenever the parking requirement for a banquet facility as an ancillary use <br />exceeds the parking requirement for the primary use, the banquet facility shall be <br />parked at the rate of I parking stall per 28 s.f. of activity/assembly area. <br />Provided however, banquet facilities ancillary to a restaurant or eating <br />establishment shall be parked at the restaurant rate of 10 parking stalls per 1000 <br />s.f. of gross floor area. <br /> <br /> SECTION 15: Banquet facilities and banquet facilities as an ancillary use shall be <br />permitted in the Specific Plan and Specific Development zoning districts wherever <br />restaurants or eating establishments are permitted, subject to a conditional use permit, <br />provided, all banquet facilities must conform to the development and operational <br />standards set forth in 41-199.1. <br /> <br /> SECTION 16: Repeal of Emergency Ordinance. Ordinance No. NS-2441 of the <br />City of Santa Ana, an emergency ordinance prohibiting the establishment of banquet <br />facilities citywide, shall be repealed as of the effective date of this Ordinance, provided, <br />however, that should enforcement of this Ordinance be enjoined by a Court of competent <br />jurisdiction prior to its effective date, then Ordinance No. NS-2441 shall remain in full <br />force and effect. <br /> <br /> SECTION 17: If any section, subsection, sentence, clause, phrase or portion of <br />this ordinance is for any reason held to be invalid or unconstitutional by the decision of <br />any court of competent jurisdiction, such decision shall not affect the validity of the <br />remaining portions of this ordinance. The City Council of the City of Santa Ana hereby <br />declares that it would have adopted this ordinance and each section, subsection, <br />sentence, clause, phrase or portion thereof irrespective of the fact that any one or more <br />sections, subsections, sentences, clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br /> <br /> SECTION 18: Neither the adoption of this ordinance nor the repeal hereby of any <br />ordinance shall in any manner affect the prosecution for violation of ordinances, which <br />violations were committed prior to the effective date hereof, nor be construed as affecting <br />any of the provisions of such ordinance relating to the collection of any such license or <br />penalty or the penal provision applicable to any violation thereof, nor to affect the validity <br />of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited <br />pursuant to any ordinance and all rights and obligations thereunder appertaining shall <br />continue in full force and effect. <br /> <br />ADOPTED this 18th dayof September <br /> <br />,2000. <br /> <br />Ordinance No, NS-2445 <br /> Page 9 of 10 <br /> <br /> <br />
