Under these two decisions Sc~thern Cal.~diao~ Company has a franchise right under the Oonetitution to occupy the streets of Santa Ana with its electric distributing system for distributing electric current for lighting ~urposee, and is only required to obtain from the City a franchise for distributing current for power and heating purposes. Said Company has such a franchise and should therefore be required to pay only under the franchise inquestion, vim: Specially granted ~ranchise, a percentage upon the gross receipts by it received from the distribution and sale of current for heating and power purposes." This report was on motion of Trustee Tubbs, dmly eecon~ ed by McPhee, accepted by m~animoue vote. On motion of Trustee Maryatt, duly seconded by Green- leaf, that the curbing on Tenth St., between Ross and Van Ness be put in under the Vrooman Act procedure, carried. · motion made by Trustee Tubbs that the City accept the offer made by the Gilleepie Co., to furnish the City a grade of 75 per cent asphaltic road oil at $1.§0 per bbl., heated and applied, was duly seconded by Maryatt and carried. Trustee Tubba made the following report of the Joint Ccmmit~ee consisting of A.N.Zerman and J.C.Met--gar of the M.& M.Assoc., R.L.Bisby and O.S.Xendall of the Chamber of Commerce, and Trustees Tubbs and Greenleaf o~the Board in reference to granting the Pacific ~lec- tric Railroad 0o., a curve on the Northwest corner of 4th and Main ets., that a curve would be granted them under the following conditions; that the Company put in trilby rails from Baker to the S.P.track on East Fourth Street on or before two years, pave the strip on FASt Fourth from the Santa Fe tracks to the gaet City limits, remove poles on 4th from Ross to Mortimer and on Main from 4th to 6th; all through Santa Aha cars to read Santa Aha; all through Orange cars to read Santa Aha & Orange, for which the City would gran said curve and abandon the franchise on East 4th beyon~ the Santa Fe tracks. A motion by Trustee Tubbe that the 0ity Attorney be instructed to present this offer in writing to the Pacific Electric Ry. Co., was duly seconded by Greenleaf and carried. A motion by Trustee Tubbe that the public speaking restricted district be extended to Broadway including Broadway on the North side of 4th to take effect ~n $0 days was duly seconded by Greenleaf and carried.
