NS- 2394 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AMENDING VARIOUS SECTIONS OF <br />CHAPTER 36 OF THE SANTA ANA MUNICIPAL CODE <br />TO REVISE THE MUNICIPAL CODE DUE TO CHANGES <br />IN THE CALIFORNIA VEHICLE CODE AND <br />CONSTRUCTION OF MEDIANS ON CITY STREETS. <br /> <br /> WHEREAS, the City of Santa Ana desires to ensure the safety of <br />pedestrians and vehicular travel within City limits; and <br /> <br /> WHEREAS, the construction of medians on City streets has created an <br />undefined area of travel within Santa Ana roadways; <br /> <br /> WHEREAS, the definition of pedestrian has been amended in the California <br />Vehicle Code; and <br /> <br /> WHEREAS, the changes in the streets of Santa Ana and the California <br />Vehicle Code has created ambiguity within the Santa Ana Municipal Code. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES ORDAIN AS FOLLOWS: <br /> <br />SECTION 1: That Santa Ana Municipal Code section 36-8 is hereby adopted to <br />read as follows: <br /> <br />Sec. 36-8. Parkway. <br />The parkway is that portion of the street other than the roadway, median or the <br />sidewalk. <br /> <br />SECTION 2: That Santa Ana Municipal Code section 36-10 is hereby adopted <br />to read as follows: <br /> <br />Sec. 36o10. Pedestrian. <br />(a) A pedestrian is any person who is afoot or who is using a means of <br />conveyance propelled by human power other than a bicycle. <br /> <br />(b) A pedestrian includes any person who is operating a self-propelled <br />wheelchair, invalid tricycle, or motorized quadricycle and, by reason of physical <br />disability, is otherwise unable to move about as pedestrian as specified in <br />subdivision (a). <br /> <br /> <br />
