of this section the term "primary residence" shall have the same definition <br />as under California Health & Safety Code section 50519(b)(1)). Any <br />hotel/motel that rents, lets or otherwise provides for compensation, twenty- <br />five percent (25%) or more of the total number of rooms therein to any <br />person, firm, partnership, corporation, association, or other business entity <br />for occupancy which exceeds 28 consecutive days or 28 days in any 60 <br />day consecutive period shall be deemed to be a transient/residential hotel. <br />No transient/residential hotel may be established in the City after June 7, <br />1999 unless (a) it was existing on June 7, 1999, and (b) it is permitted by a <br />SP (Specific Plan) or SD (Specific Development) district and then only as a <br />conditional use. <br /> <br /> Section 7: Section 41.77 of the Santa Ana Municipal Code is amended <br />to read as follows (new language in bold, repealed language in strikeout): <br /> <br />Sec. 41-77. Hotel/Motel. <br /> <br />A hotel/motel is any building, or portion of a building, other than a care home e~ <br />m ..... which is designed, occupied, used or intended to be used, rented or <br />hired out as temporary or overnight accommodations for tourists or <br />transients. Such hotel/motel shall containing more than five (5) guestroomsv. <br />O; ............ ~ ~ ................... <br /> <br />hotel/motel that contains a kitchen (as defined in section 310.7(3) of the <br />California Building Code) in guest rooms shall be deemed to be an long- <br />term stay business hotel. A hotel/motel that meets the criteria of section <br />41-139 of this Code shall be deemed to be a transien~residential hotel. <br /> <br /> Section 8: Sections 41-690.1 through 41-690.4 are added to Chapter 41 of the <br />Santa Ana Municipal Code to read in full as follows (new language in bold): <br /> <br />Sec. 41-690.1. <br />Hotels. <br /> <br />Amortization of Non-Conforming Transient/residential <br /> <br />Any use of real property existing on June 7, 1999, which is a <br />transient/residential hotel as defined in section 41-139 of this Code, but <br />which was constructed, operated, and maintained in compliance with all <br />regulations and design and development standards adopted by the City, <br />shall be regarded as a nonconforming use which may be continued until <br />July 1, 2004. On or before such date, all such nonconforming uses shall be <br />terminated unless an extension of time has been approved in accordance <br />with the provisions of section 41-690.4 below. <br /> <br />(a) Abandonment.
