(30) days. <br /> <br /> Such appeal shall be placed on the agenda of the city council for its next regular <br />meetin.q, at which time the city council shall declare that a public hearinq on the matter <br />will be held at its next subsequent regularly scheduled meeting. The intervening time <br />may be used by the city council for further investiqation of the matters in question. <br /> <br /> At the regularly scheduled city council meeting set for public hearing of the <br />appeal, the city council shall consider the appeal de novo and shall seek such additional <br />testimony or advice as they may feel desirable to assist in reaching a decision. The city <br />council shall accept, accept subject to improvement or reject the offer of dedication <br />within ten (10) days followinq the conclusion of the public hearing, and make written <br />findings supporting its decision as may required by the Subdivision Map Act. <br /> <br /> SECTION 25: That Santa Aha Municipal Code section 34-212 is hereby <br />amended to read as follows: (new language in bold, deleted language in strikeout) <br />Sec. 34-212. Commencement of development. <br /> At the time of the approval of the final subdivision map the city ccu~c!! engineer <br />shall specify when development of the park or recreational facilities shall be <br />commenced. <br /> <br /> SECTION 26: If any section, subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not affect the validity of the remaining <br />portions of this ordinance. The City Council of the City of Santa Ana hereby declares that <br />it would have adopted this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one or more sections, <br />subsections, sentences, clauses, phrases; or portions be declared invalid or <br />unconstitutional. <br /> <br /> SECTION 27: Neither the adoption of this ordinance nor the repeal hereby of any <br />ordinance shall in any manner affect the prosecution for violation of ordinances, which <br />violations were committed prior to the effective date hereof, nor be construed as affecting <br />any of the provisions of such ordinance relating to the collection of any such license or <br />penalty or the penal provision applicable to any violation thereof, nor to affect the validity of <br />any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant <br />to any ordinance and all rights and obligations thereunder appertaining shall continue in <br />full force and effect. <br /> <br />ADOPTED this 3rd day of December, 2001. <br /> <br />Patricia A.
