ORDINANCE NO. NS-2484 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AMENDING SECTION 1-21.1 OF THE <br />SANTA ANA MUNICIPAL CODE RELATING TO <br />DEFINITIONS <br /> <br />PJC/7-5-01 <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />Currently, Section 1.21.1(b) of the Santa Ana Municipal Code defines <br />enforcement officer as any police officer or those with authority as set <br />forth in section 1-18 through 1-18.4 of the code. <br /> <br />It is appropriate to revise the section to allow animal control officers <br />to issue administrative citations for violations of Chapter 5 of the <br />Santa Ana Municipal Code. <br /> <br />All provisions of the Santa Ana Municipal Code which are repeated herein <br />are repeated solely in order to comply with the provisions of section 418 of <br />the Charter of the City of Santa Ana. Any such restatement of existing <br />provisions of the Code is not intended, nor shall it be interpreted, as <br />constituting a new action or decision of the City Council, but rather such <br />provisions are repeated for tracking purposes only in conformance with <br />the Charter. <br /> <br /> Section 2. Section 1-21.1 of the Santa Ana Municipal Code is hereby amended <br />to give authority to animal control officers to issue administrative citations, such that it reads as <br />follows (new language in bold, deleted language in strikeout): <br /> <br />Sec. 1-21.1. Definitions. <br /> <br />(a) Responsible person. A responsible person is any of the following: <br /> <br />(1) A person who causes a Code violation to occur. <br /> <br />(2) A person who maintains or allows a Code violation to continue, by his <br />or her action or failure to act. <br /> <br />(3) A person whose agent, employee, or independent contractor causes a <br />Code violation by its action or failure to act. <br /> <br />Ordinance No, NS-2484 <br /> Page 1 of 3 <br /> <br /> <br />
