The <br />proposed project exists in an urban environment characterized by paved concrete, <br />roadways, surrounding buildings and human activity. Therefore, pursuant to Fish and <br />Game Code § 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game <br />Department filing fees is not required in conjunction with this project. <br /> <br /> Section 3. Section 17-74 of the Santa Ana Municipal Code is hereby amended <br />such that it reads as follows (new language in underline, deleted language in strikeout): <br /> <br />Sec. 17-74. Replacement prohibited. <br /> <br />If the public nuisance to be abated is one defined in section 17-72: <br /> <br />(1) The hearing notice required by section 17-21 shall specify that <br />abatement shall consist of removal of the pay telephone, revocation of the <br />land use certificate issued pursuant to section 41-198.100, and that no <br />pay telephone shall be installed on the same parcel, or on any contiguous <br />parcel owned by the same property owner, to replace the removed <br />telephone for a period of one (1) year from the date of removal; and <br /> <br />(2) Any decision of the hearing officer ordering abatement shall specify <br />that the land use certificate issued pursuant to section 41-198.100 is <br />revoked, and no pay telephone shall be installed on the same parcel, or <br />on any contiguous parcel owned by the same property owner, to replace <br />the removed telephone for a period of one (1) year from the date of <br />removal. <br /> <br /> Section 4. Section 41-198.100 of the Santa Ana Municipal Code is hereby <br />amended such that it reads as follows (new language in underline, deleted language in <br />strikeout): <br /> <br />Sec. 41-198.100. Exterior pay phone facilities. <br /> <br />(a) <br /> <br />Extedor pay phone facilities are not permitted in the RE, R1, R1-4000, R2, <br />R3, PD, PCD or SD use district which is planned or developed for <br />residential use. <br /> <br />(b) In use districts other than those specified in subsection (a) of this section: <br /> <br />(1) <br /> <br />A land use certificate is required, in accordance with sections 41- <br />675 through 41-677, for each exterior pay phone installed.
