ORDINANCE NO. NS-2498 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING SPECIFIC DEVELOPMENT 65 ZONING DISTRICT (DISCOVERY SCIENCE CENTER) THE CITY COUNCIL OF THE CITY OF SANTA ANA ORDAINS AS FOLLOWS: Section 1. The City Council hereby finds, determines and declares as follows: In 1997, pursuant to the authority of section 41-493 of the Santa Ana Municipal Code, the City established Specific Development (SD) 65, a zoning district. SD 65 was created for the express purpose of establishing land use regulations and standards for the affected property, commonly known as the Discovery Science Center. The City Council now desires to amend SD 65, to add new proposed uses to the north parcel and changes to the proposed IMAX or large screen theater. The Planning Commission has, following a noticed public hearing, on March 25, 2002 recommended approval of these amendments to SD. The City Council has held a noticed public hearing on this Ordinance, and has considered all testimony presented thereto. In conjunction with this project, the City Council has previously certified Final Environmental Impact Report No. 96-01 and its Addendum. Section 2. 1 hereto. SD 65 is hereby approved and adopted to read as set forth in Exhibit Section 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional.
