NS-2504 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING CHAPTER 31 ADDING SECTION 31-5, TO THE SANTA ANA MUNICIPAL CODE REGARDING THE ESTABLISHMENT OF RULES AND GUIDELINES AT PUBLIC SKATE PARK FACILITIES THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: The City Council hereby finds, determines and declares: The City of Santa Ana desires to provide alternative avenues of recreation within the City. Skateboarding and in-line skating, is a form of recreation that has increased in popularity within Santa Ana in recent years. Skateboarding is considered a hazardous recreational activity, as defined in California Government Code section 831.7. The increased popularity of the sports has resulted in skating on public streets and right of ways within the City. The State of California requires that all cities that have skate parks adopt an ordinance requiring any person skating in a city-owned facility must wear proper safety gear. The City desires to operate public skate facilities to address the recreational needs of the community, while providing a safe area for skaters. All provisions of the Santa Ana Municipal Code which are repeated herein are repeated solely in order to comply with the provisions of section 418 of the Charter of the City of Santa Ana. Any such restatement of existing provisions of the Code is not intended, nor shall it be interpreted, as constituting a new action or decision of the City Council, but rather such provisions are repeated for tracking purposes only in conformance with the Charter. SECTION 2: That Section 31-5 is hereby added to the Santa Ana Municipal Code to read as follows: Ordinance No. 2504 Page 1 of 4
