V OF THE CITY OF SANTA ANA <br /> <br />RESOLUTION ORDERING ACQUSITION <br /> AND IMPROVEMENT. <br /> No. 2195, <br /> <br /> ~hereas, at the time,'place and in the manner set fortk <br /> in Resolution of Intention No. 2184, adopted by the City <br /> Council of the City of Santa Aha on the 21st day of April <br /> 1930, In the Matter of Acquisition and Improvement Dis- <br /> trict No. 7 of the City of Santa Arm, a full,fair and <br /> impartial he~ring was accorded all persons having any <br /> objections to those things proposed to be done as set <br /> forth in said Resolution; and <br /> Whereas, this City Council has adopted its Resolution <br /> passing upon all protests presented, both written and <br /> oral, and has made its determination as to the extent of <br /> the Assessment District; and <br /> Whereas, evidence has been received as to the publica- <br /> tion of said Resolution of Intention No. 2154, and the <br /> posting of notice of public improvement therein ordered <br /> pested, at the time and in the manner prescribed by law, <br /> and as to the necessity for the acquisitions comtemplated <br /> and the benefits to be derived therefrom. <br /> Now, Therefore, Be It Resolved, by the City Council of <br /> the City of Santa Aha, that it is hereby found, deter- <br /> mined and ordered as follows: <br /> 1. That the said Resolution of Intention No. 2184 here- <br /> tofore adopted on the 21st day of April, 1930, has been <br /> duly and legally published as required by law, and that <br /> the notice of public improvement therein directed to be <br /> posted has been duly and legally posted, in the time, <br /> form,.manner and number as required by law, and that all <br /> protests er objections presented have been disposed of in <br /> time, form and manner as requLred by law, and that this <br /> Legislative Body has now acquired Jurisdiction to order <br /> the things proposed to be done as set forth in said Reso- <br /> lution of Intention No. 2184. <br /> 2. That the boundaries of the Assessment District for <br /> said Acquisition and Improvement District No. 7, as pro- <br /> posed in said Resolution of Intention are hereby adopted <br /> and established as to the boundaries of said Assessment <br /> District. <br /> 3. That the public intereRt and necessity requires, <br /> and it is hereby ordered that the following acquisitions <br /> for the widening of a portion of West Seventeenth Street, <br /> in the City of Santa Ana, be made to-wit: <br /> A strip of land fourteen (14) feet wide lying North of <br /> and irmmediately adjacent to the North line of Seventeenth <br /> Street and extending from the Westerly line of Main Stre~ <br /> to the Easterly line of Greenleaf Street, excepting from <br /> said fourteen (iA) foot strip of land any and all portion~ <br /> thereof used for street and alley purposes. <br /> A strip of land fifteen (1§) feet wide lying South of <br /> and immediately adjacent to the Southerly line of Seven- <br /> teenth Street and extending from the Westerly line of <br /> Main Street to the Easterly line of Flower Street, excep- <br /> ting from said fifteen (15) foot strip of land an~ and <br /> all portions thereof used for street and alley purposes; <br /> all as set forth and described in said Resolution of In- <br /> tention No. 218A, passed and adopted on the 21st day of <br /> April, 1930, and in the specifications referred to, and <br /> that the property necessary to be taken fer such widening <br /> of West Seventeenth Street, and which is hereby ordered <br /> to be acquired therefor, is that described in Section 1 <br /> of said Resolution of Intention. <br /> 4. That the City Attorney of the City of Santa Aha is <br />hereby ordered to bring an action in the name of the City <br />of Santa Ana, in the Superior Court of the State of Cali- <br />fornia, in and for the County of Orange, for the condemns. <br />tion of the property necessary to be taken for the acqui- <br />sitions herein ordered, and described in Section 1 of <br />said Resolution of Intention No. 218A, and to do all <br />things necessary to prosecute said action to final deter- <br />mination. <br /> 8. That the public interest and necessity require, and <br />it is hereby ordered that the City of Santa Ana, plaintif~ <br />in the said condemnation action, take immediate posses- <br />sion and use of the property herein ordered to be acquir~ <br />upon complying with the requirements of law applicable <br />thereto, and that the said City Attorney report to this <br />City Council the amounts of money required therefor as <br />soon as the same can be ascertained. <br />6. That to defray the expenses of the acquisitions <br />herein ordered bonds will be issued to the total amount of <br /> <br /> <br />
