RESOLUTION NO. 52-102 <br /> <br /> RESOLUTION DIRECTING TAX REFUND TO THE YOUNG MEN'S <br /> CHRISTIAN ASSOCIATION OF SANTA ANA AND AUTHORIZING <br /> THE COUNTY OF ORANGE TO WITHHOLD FROM CURRENT COL- <br /> LECTIONS FOR REIMBURSEMENT <br /> <br /> WR]~EAS, heretofore the Supreme Court of the State of <br />California in a decision cited as 35 Cal. (2d) 760, held that cer- <br />tain types of property held by a Y. M. C. A. were exempt from tax- <br />ation; and <br /> <br /> WHEREAS, the Y. M. C. A. in Santa Ana paid their 1950-51 taxes <br />under protest to the County of Orange and the City of Santa Aha <br />under Assessment Number 5332, Book 3, Page 136; and <br /> <br /> WHEREAS, all the issues in the case cited hereinabove were <br />applicable to the local situation and an application of the princi- <br />ples laid down in said decision entitled the Y. M. C. A. to a refund <br />of a large portion of said tax so paid; and <br /> <br /> WHEREAS, the County of Orange has heretofore taken action to <br />refund those portions of said taxes improperly assessed, levied, and <br />collected and has requested that the City of Santa Ana authorize the <br />return of its portion of said tax; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the County of Orange is <br />hereby authorized and directed to refund to the Young Men's Christian <br />Association of Santa Aha, a Corporation, the sum of $285.59 paid <br />under protest under said Assessment Number 5332 as aforesaid and the <br />County of Orange is hereby authorized to withhold from current collec- <br />tions due to the City of Santa Ana, the amount of $285.59 in reimburse- <br />ment for the amount so refunded. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa Aha <br />at its regular meeting held on the 1st day of December, 1952. <br /> <br />ATTEST :~ <br /> CITY CLERK <br /> <br />(SEAL) <br /> <br /> <br />
