RESOLUTION AUTHORIZING QUITCLAIM DEED TO TtiE STATE OF CALIFORNIA <br />~ND EXECUTION OF RIGHT OF ~!~AY CONTRACT WITH THE STATE OF CALIFORNIA <br /> <br /> ~EREAS, the State of California filed an action in eminent domain <br />in the Superior Court of the State of California in and for the County <br />of Orange, the same being Number 55933 in which the City of Santa Ana <br />was named as a party defendant for property held by said City for the <br />Joint 0utfall Sewer to create an expressway along the Coast Highway <br />which said action affects property on the south side of said Highway, <br />Westerly from the Santa Ana River; and the City of Santa Aha there- <br />after filed its Answer to said Complaint and a compromise has been <br />agreed upon and approved by the Executive Committee of the Orange <br />County Joint 0utfall Sewer whereunder the City of Santa Aha will quit- <br />claim to the State of California, all its interest in and to Parcel 1 <br />as described in said Complaint and will receive back from the State of <br />California, a Right of way Contract to cross over the area theretofore <br />held by the City and for installation by the State of a 14 foot gate <br />Io~ the use of the Joint Outfall Sewer to provide access to the Chlori- <br />nation Station and other works; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the Council of the City of <br />Santa Aha hereby approves the compromise effected and authorizes the <br />Mayor and the City Clerk to execute a Quitclaim deed granting to the <br />State of California that certain Parcel of real property in the County <br />of Orange described as follows: <br /> <br /> A strip of land 40.00 feet in width, in Sacs. 13, 14 and 24, <br />T. 6 S., R. ll W., and in Sec. 19, T. 6 S., R. l0 W., within the <br />Rancho Las Bolsas, as per map recorded in Book 2, page 314 of Patents, <br />records of Los Angeles County, said strip of land more particularly <br />described as being 20.00 feet on each side of the following de- <br />scribed center line: <br /> Beginning at the southeasterly terminus of that certain 4° <br />tapered railway curve concave Northeasterly, described in second in <br />deed from Pacific Electric Land Company to Southern Pacific--~road <br />Company in Book 123, page 96 of Deeds, records of said Orange Coun- <br />ty, said point of beginning being N. 5° 15' W., 148.05 feet from a <br />4" x 4" stake marked "N-5", said stake being in the northeasterly <br />line of that certain strip of land 40 feet in width conveyed by <br />Stearns Ranchos Company and Robert J. Northam to the Santa ~na and <br />Newport Railway Company by deed recorded in Book 44, page 66 of said <br />Deeds; thence tangent, S. 53° 06' E., 3876.13 feet to the point of <br />beginning of a railway curve to the left having a radius of 11409.2 <br />feet; thence Southeasterly along said railway curve to the left, <br />~71.2~ feet to the end of said railway curve to left; thence tangent <br />S. 55~ 28' E., 3714.77 feet to the point o2 beginning of railway <br />curve to the left having a radius of 5679.6 feet; thence Southeast- <br />erly along said last mentioned railway curve to the left~ $27.71 feet <br />to the end of said curve to the left; thence tangent 63° <br /> S. 49' E., <br />1007.03 feet to the point of beginning of a railway curve to the <br />right having a radius of 5779.6 feet; thence Southeasterly along said <br />railway curve to right, 9S1.S2 feet to the end of said railway curve <br />to the right; thence S. 54° 05' E., 2730.54 feet to a point in the <br />easterly line of said Rancho Las Bolsas, distant thereon, S. 15° 41' <br />W., 547.48 feet, more or less, from Station 65 on the boundary line <br />of said Rancho Las Bolsas. <br /> EXCEPT a strip of land 40.00 feet in width in said Section 14, <br />being 20.00 feet on each side of the following describe~ center line: <br />Beginning at the said southeasterly terminus of a 4o tapered railway <br />curve; thence S. 53° 06' E., 185.2 feet. <br /> <br /> <br />
