RESOLUTION NO. 53-51 OF THE COUNCIL OF THE CITY OF SANTA ANA DECLARING T~T NO CITY PROSECUTOR IS CHARGED WITH THE DUTY OF PROSECUTING MISDEMEANOR OFFENSES RE- SULTING FROM VIOLATION OF STATE STATUTES AND REQUESTING THE DISTRICT ATTORNEY OF ORANGE COUNTY TO PROVIDE FOR PROSECUTION OF SUCH OFFENSES ~REAS, the reorganization of inferior courts in the State of California has resulted in the establishment of the Municipal Court of Santa Ana-0range Judicial District which said Court has jurisdiction of all misdemeanors arising in the City of Santa Aha; and WHEREAS, some Deputy from the District Attorney's Office is almost constantly in attendance at such Court during such times as are there provided for the hearing of criminal matters; and ~EREAS, on the l~th day of April, 1953 at the hour of 8 o'clock P. M. the Charter of the City of Santa Ana became effective for all purposes and thereby provided a new form of government for said City and there is not now, any City Prosecutor or Officer charged with the duty of prosecuting misdemeanor offenses arising upon violations of the statutes of the State of California and in the opinion of the City Council such prosecution of misdemeanor of- lenses arising under violations of the statutes of the State of Cal- ifornia does not warrant the attention of the City Attorney of said City and would be properly handled by the Office of the District Attorney of Orange County and greater efficiency would result by the assignment of a Deputy from the Office of said District Attorney to said Court for all criminal actions prosecuted therein from whatever portion of said Judicial District they might arise; NOW, T~LLEREFORE, BE IT RESOLVED; THat the City Council of the City of Santa Aha hereby requests the District Attorney of Orange County, California to prosecute all misdemeanor offenses arising upon violation of the statutes of the State of California occurring within the incorporated limits of the City of Santa Aha.
