A AhUD SANTA FE ~IL~JAY C0~ .SP~ T~CIf <br />ACROZS ?~ASHiNGTON ST~T <br /> <br /> ?~U~ER~S, the ATCHISON, TOPEI~ A~ S~D~A FE RAILWAY C0~LOANY <br /> <br />has filed an Application dated March 4, 1954, seeking authority <br />from the City to construct, maintain and operate a spur track <br />connecting its lines with a new industry, across 'Jashington Street, <br />to facilitate the delivery of freight to said industry; and <br /> <br /> ~RF~AS, the Public %~orks Department of the City of Santa ~na <br />has examined said Application, plan and profiles and has found no <br />objection thereto; <br /> <br /> N0~, ~EREFORE, BE IT RESOL~D: That the City Council of the <br />City of S~nta Ann does hereby approve the Application hereinabove <br />referred to and hereby grants and issues a Per~-~it to the ATCHISON, <br />TOPEI~A 'Y20 SAA~A FE RAI~Y C0tfPAL~Z_ for the construction,maintenance <br />and operation of a spur track across the City right of wsy on IVash- <br />ington Street in the City of Santa Ann, County of Orange, State of <br />California described as: <br /> <br /> Beginning at a point in the northerly lino of ~;ashington <br /> Street, distant thereon 28.2 f~et easterly of the easterly <br /> line of Lincoln Street; thence southerly 60.0 feet on a 22,904.3- <br /> foot radius curve, concave easterly, to a point in the southerly <br /> line of ~!ashingto~ Street, distant thereon 8.8 feet easterly of <br /> the easterly line of Lincoln Street, <br /> <br />under the authority and in compliance with the terms and conditions <br /> <br /> of the City of Santa ann and under the following con- <br /> <br />of the Charter <br />ditions: <br /> <br /> (a) That <br /> <br /> said Permittee shall pay all charges resulting from <br />inspection of all construction work occasioned by t~e construction <br />of said spur track; <br /> <br /> (b) Thst Permittee shall pay all expenses, costs of construc- <br />tion, maintenance and repair occasioned by the construction, main- <br />tenance, operation and necessary repair of said spur track, includ- <br />ing the cost of all street work involved in the construction of any <br />new approach made necassary by the construction of said spur track; <br /> <br /> <br />
