RESOLUTION NO. 54-99 ACCEPTING EAS~WENT DEED FOR <br /> DRAINAGE PURPOSES <br /> <br />WHEREAS, DO)lANDER P. LEONARD and EDNA M. LEONARD, husband and wife, <br /> <br />have presented to the City Council an easement deed dated June 10, 1954, <br /> <br />without consideration, conveying property in the City of Santa Ana, County of <br /> <br />Orange, State of California, described as: <br /> <br /> An easement for drainage purposes over, and along the North 12 feet <br />of Lot 14 of Potts, Borden and Sidwell Tract, as shown on a map thereof <br />recorded in book 4, page 624, of Miscellaneous Records of Los Angeles <br />County, California. <br /> <br /> The grantors herein, their successors and assigns, shall have the <br />right to use and maintain said 12 foot strip as a private roadway, <br />with access thereto at any point. <br /> <br /> This easement deed is given for the purpose of providing drainage for <br />proposed Tract No. 2089, and if the map of said Tract No. 2089 is not <br />recorded within one year from date, or if satisfactory drainage is pro- <br />vided Westerly to Bristol Street along another route, the surface drainage <br />easement herein granted shall cease and be abandoned. <br /> <br /> The grantee herein agrees not to distmr~b trees within said 12 foot <br />easement without the consent of the grantors herein. <br /> <br /> The exact location of the drainage ditch to be located within said <br />12 foot easement is to be determined by the grantors herein. <br /> <br /> This easement is limited to surface drainage only by open ditch ~hich <br />shall not be over 5 feet in width nor i foot in depth and shall not be <br />surfaced with any pavingm~terials. <br /> <br />NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana accepts said <br /> <br />deed and the Clerk of the Council is hereby instructed to cause said deed to be <br /> <br />recorded with the County Recorder of Orange County, California. <br /> <br />PASSED AND ADOPTED by the City Council of the City of Santa Ana at <br /> <br />its adjourned <br /> <br />ATTEST:~ <br /> <br />CLERK OF THE COUNCIL <br /> <br />regular meeting held on the 28th day of June , 1954. <br /> <br />STATE OF CALIFORNIA ) <br />COUNTY OF ORANGE ) SS <br />CITY OF SANTA ANA ) <br /> <br /> I, EP~ KEELER, do hereby certify that I am the Clerk of the Council of <br />the City of Santa Ana; that the foregoing Resolution was regularly introduced to said <br />Council at its adjourned regular meeting held on the 2$th day of June , 1954, <br />and was at said meeting regularly passed and adopted by the following vote, to-wit: <br /> <br />AYES, COUNCIIAW~N: William Jerome, Thomas Fo Larsen, Courtney H.
