Sections <br />4 & 5 of Ord. 1131 <br />(B~cycles) <br /> <br /> In Re <br />Request <br />~hief of Police <br /> (Clerk-typist) <br /> <br />Trustee Chandler requested the Olerk to read w~itten opinion of <br /> <br />MarJorie Mize, Assistant City Attorney, as follows: <br /> <br />"Regarding Council action on the Auditor and Purchasing <br />Agent change, it would seem that Section 30, Ordinance <br />No. 1056, controls the question whether the office of <br />City Auditor and PUrchasing Agent can be withdrawn or <br />not. This Section states that no department shall be <br />withdrawn without the vote of the elwotors. Under the <br />same Section it would seem that the City Council could <br />add an additional auditing department and under-Rule 5 <br />of the Rules and Regulations of the Civil Service <br />Commission providing for the compensation plan and <br />increase by resolution of the City Council, it would <br />seem that the City 0ouncil has the right to make a <br />special salary adjustment evan without the approval of <br />the Chief Examiner.. As these m~tters seem to be <br />exclusively municipal affairs, I believe the ordinance <br />and the rules under the ordinance are controlling." <br /> <br />The Ordinance was read, considered, designated Ordinance No. 1273 <br /> <br />and passed by the following vote: <br /> <br />Ayes, T~ustees <br /> <br />Noes, Trustees <br />~bsent, Trustees <br /> <br />John W. Martin Jr., Virgil H. Reed, <br />Allen A. Mandy. <br />W.J.Oheney, Courtney R. Chandler. <br />None <br /> <br />On motion of Trustee Chandler, seconded by Cheney and carried, the <br /> <br />opinion of Assistant City Attorney was received and filed. <br /># <br />On motion of Trustee Chandler, seconded by Cheney and carried, the <br /> <br />following Ordinance entitled: <br /> <br />"An Ordinance of the City of Banta Ana <br />declaring their intention to vacate a <br />portion of Brown Street, describing said <br />portion proposed to be vacated,a~A <br /> <br />~ and fixing time and place for hear- <br />ing of all persons interested in or object- <br />ing to the proposed vacation" <br /> <br />was rea~, considered, designated Ordinance No. 1274 and passed by <br />the following vote: <br /> <br />Ayes, Trustees <br /> <br /> Noes, Trustees <br /> Absent, Trustees <br /># <br /> <br />On motion of Trustee <br /> <br />W.J.Cheney, Courtney R. Mandy. <br />None <br />None <br /> <br />Cheney, seconded by Chandler and carried, the <br /> <br />following Ordinance entitled: <br /> <br />"An Ordinance of the City of Santa Aha <br />amending Ordinance No. 1247" <br /> <br />was introduced, read, considered and placed on file for second <br /> <br />reading. <br /> <br />Ob motion of Trustee Chandler, <br /> <br />seconded by Cheney and carried, the <br /> <br />following 0rdinanoe entitled: <br /> <br />"An Ordinance repealing Section 3 of Ordinance <br />Number ? and Section 2 of Ordinance Number 828 <br />and providing for signature of warrants" <br /> <br />was introduced, read, considered and placed on file for second <br /> <br />reading. <br />. <br />On motion of Trustee Chandler, seconded by Cheney and carried, the <br /> <br />following Ordinance entitled: <br /> <br />"An 0~dinance amending Sections 4 and 5 of <br />City Ordinance No. 1131 providing for the <br />registration of bicycles" <br /> <br />was introduced, read, considered and placed on f~le for second <br /> <br />reading. <br />. <br /> <br />On recommendation of the Police Commissioner and on motion of <br /> <br />Trustee Martin, seconded by Reed and carried, the request of Chief <br />of Police for additional clerk-typist, was granted. <br /> <br /> <br />
