Sections 4 & 5 of Ord. 1131 (B~cycles) In Re Request ~hief of Police (Clerk-typist) Trustee Chandler requested the Olerk to read w~itten opinion of MarJorie Mize, Assistant City Attorney, as follows: "Regarding Council action on the Auditor and Purchasing Agent change, it would seem that Section 30, Ordinance No. 1056, controls the question whether the office of City Auditor and PUrchasing Agent can be withdrawn or not. This Section states that no department shall be withdrawn without the vote of the elwotors. Under the same Section it would seem that the City Council could add an additional auditing department and under-Rule 5 of the Rules and Regulations of the Civil Service Commission providing for the compensation plan and increase by resolution of the City Council, it would seem that the City 0ouncil has the right to make a special salary adjustment evan without the approval of the Chief Examiner.. As these m~tters seem to be exclusively municipal affairs, I believe the ordinance and the rules under the ordinance are controlling." The Ordinance was read, considered, designated Ordinance No. 1273 and passed by the following vote: Ayes, T~ustees Noes, Trustees ~bsent, Trustees John W. Martin Jr., Virgil H. Reed, Allen A. Mandy. W.J.Oheney, Courtney R. Chandler. None On motion of Trustee Chandler, seconded by Cheney and carried, the opinion of Assistant City Attorney was received and filed. # On motion of Trustee Chandler, seconded by Cheney and carried, the following Ordinance entitled: "An Ordinance of the City of Banta Ana declaring their intention to vacate a portion of Brown Street, describing said portion proposed to be vacated,a~A ~ and fixing time and place for hear- ing of all persons interested in or object- ing to the proposed vacation" was rea~, considered, designated Ordinance No. 1274 and passed by the following vote: Ayes, Trustees Noes, Trustees Absent, Trustees # On motion of Trustee W.J.Cheney, Courtney R. Chandler, John W. Martin Jr., Virgil H. Reed, Allen A. Mandy. None None Cheney, seconded by Chandler and carried, the following Ordinance entitled: "An Ordinance of the City of Santa Aha amending Ordinance No. 1247" was introduced, read, considered and placed on file for second reading. Ob motion of Trustee Chandler, seconded by Cheney and carried, the following 0rdinanoe entitled: "An Ordinance repealing Section 3 of Ordinance Number ? and Section 2 of Ordinance Number 828 and providing for signature of warrants" was introduced, read, considered and placed on file for second reading. . On motion of Trustee Chandler, seconded by Cheney and carried, the following Ordinance entitled: "An 0~dinance amending Sections 4 and 5 of City Ordinance No. 1131 providing for the registration of bicycles" was introduced, read, considered and placed on f~le for second reading. . On recommendation of the Police Commissioner and on motion of Trustee Martin, seconded by Reed and carried, the request of Chief of Police for additional clerk-typist, was granted.
