Building (Variance of O~son Realty Co) RESOLUTION M0. ~6-9 CORRECTING ERROR IN VARIANCE GRANTED FEBRUARY 21ST, 195~ WHEREAS, heretofore on Variance Application No. 584 the Plan- ning Commission, after due hearing, recommended the granting of said Variance by Resolution No. 742 and said recommendation was concurred in by the City Council and the Variance granted under the conditions there set forth on February 21st, 1955; and ~EREAS, in the original application for said Variance which requested an addition to an existing building for an enlargement of the use on property knovn% and numbered as 1120 W. H!,~aland Street, to be used for the distribution of eggs, upon the condition that the building addition be set back 72 feet from the street and said set- back was incorporated as a condition both by the recoramendation of the Planning Commission and the ~pproval of the City Council; and WHEREAS, an error had occurred in measurements taken by the Engineer which error had been included in the map, the application, and adopted by the Planning Commission and the City Council, which said error consisted of approximately 1k ~ feet between said street and said building addition; and ~P~tEREAS, steel beams have been ordered and fabricated and other work done on said building prior to the discovery of said error and said setback is greater than required of other properties in the neigh- borhood; NOW, THEREFORE, BE IT ~SOLVED: That the City Council of the City of Santa &no does hereby change the condition in the granting of said Variance to require that the building be set back 70 feet from the street to correct said error in measurement and in the instruments hereinabove referred to.
