BE IT FURTHER ~ESOLVED: 1. ~at the City of ~anta Aha is authorized and empowered to provide for the const~ction and widening of streets within the City Limits and to acquire by Eminent Domain under the circumstances here- inabove set out a fee simple estate in any parcel of ground necessary for said street construction and/or widening. 2. The said City Council hereby declares that the location of said public improvement is planned and located in a manner Which will be most compatible with the private injury. 3. The public interest, greatest public good and the least necessity and convenience require, and it is hereby o~dered, that the City of Santa Aha, Plaintiff in condemnation action ordered herein, take immediate possession and use of the property herein ordered to be acquired, upon complying with the requirements of law applicable thereto. 4. The City Attorney is hereby ordered to bring an action in the name of the City of Santa Aha in the Superior Court of the State of California, in and for the County of Orange, bo condemn the property herein described, to do all things necessary to prosecute said action to final determination, to make application to said Court for an order fixing the amount of security in the fo~m of money de- posits as said Court may direct, for an order permitting said City to take immediate possession and use of said real property for public use, and to ~eport the amount of money so required by the court as such security, and to do those things necessary to insure that said amount be deposited with said Court. 5. The s~id action for condemnation of said property so to be acquired shall be taken in accordance with Section 14, Article I of the Constitution of the State of California.
