105 <br /> <br />RESOLUTION NO. 612. <br /> <br /> Trustee J.W. Tubbs introduced and moved the adoption <br /> <br /> of the following Resolutlon:e <br /> <br /> Whereas, it appears and is h~reby determined that <br /> <br /> the public interest and also the public necessity demands that <br /> the sewer system of the city of Santa Aha, including the outfall <br /> sewer thereof, be repaired, enlarged, extended and improved and <br /> that it is necessazy that this Board of Trustees take proper <br /> action for the immediate and necessary improvement thereof, and <br /> <br /> ~hereas, it appears that certain other municipal cor- <br /> porations created and existing in the County of Orange, to-wit: <br /> the city of Fullerton, the city of Anaheim, and the city of <br /> Orange, by their respective Boards of Trustees, have been and are <br /> considering that it is and will be to the interest and advantage <br /> of said municipal corporations to enter into a Joint agreement <br /> by and between said municipal corporations and the city of Santa <br /> Ana authorizing the construction and maintenance of sewers at the <br /> joint cost and expense of and for the Joint use and benefit of <br /> said municipal corporations; and <br /> <br /> Whereas, it appears to the Board of Trustees of the <br /> City of Santa Aha that the Joint construction, maintenance, and <br /> use of sewers for the benefit of said municipalities, or such <br /> of them as may ultimately enter into a Joint agreement for that <br /> purpose, is feasible and practicable, and will provide adequate <br /> and convenient sewers for all of such municipal corporations <br /> at a greet earing of cost, both in original construction and <br /> future maintenance, and <br /> <br /> Whereas, it appears that in the formation, consideration <br />and execution of such Joint agreement and in the ultimate con- <br />struction and maintenance of a sewer at the joint cost and expense <br />of and for the joint use and benefit of said municipalities, <br />there is and wil~ be involved and necessary to consider and perform <br />extensive engineering and legal services: <br /> <br /> Therefore, be it resolved and ordered that the President <br />of the Board of Trustees of the city of Santa Ana appoint a <br />committee consisting of two members of the Board of Trustees of <br />said city, and that said committee be and is hereby vested with <br />power to employ such engineering and legal services and assistance <br />as shall be necessary as follows: <br /> <br /> (1) To accomplish the proper improvement of the sewer <br />system of the city of Santa Aha, including the outfall sewer <br />thereof. <br /> <br /> (2) In the event that the city of Fullerton, the city <br />of Anaheim, and the city of Orange, municipal corporations in <br />the County of Orange, or some of said municipal corporations, <br />shall, by proper action of their respective hoards of trustees, <br />seek to enter into a Joint agreement by and between such municipal <br />corporations and the city of Santa Aha for the construction and <br /> <br /> <br />
