RESOLUTION NO. ~8-~9 ACCEPTING DEED GRAi~TING EASEMENT <br />FOR THE WIDENING OF NORTH MAIN STREET AND SETTING OUT <br />T~E WORK TO BE DONE BY THE CITY IN SAID WIDENING <br /> <br /> WHEREAS, ARTHUR H. SWANSON and ABBIE'SWANSON have presented to <br />the City a deed granting easement for the purpose of widening North <br />Main Street over the real property in the City of Santa Ana, County of <br />Orange, State of California, without cash consdderation, described as: <br /> <br /> An easement for street purposes over: <br /> <br /> The westerly ?.~ feet of Lots ll and 13 of the Maple Tract, <br /> as shown on a map thereof recorded in Book 4, Page 9, Mis- <br /> cellaneous ~laps, records of said Orange County. <br /> <br />EXCEPTING that portion previously dedicated for street purposes. <br />NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana <br />accepts said deed, agrees with grantors that the City at its own proper <br />cost and expense will do or cause to be performed the following work: <br /> <br /> 1. Replace the curb and sidewalk to the new width and pave the <br />area between t~e gutter and existing paving. <br /> <br /> 2. Construct a retaining wall at a new location Just east of <br /> <br />the new property line. <br /> <br /> 3. Reconstruct the present drivews~ at a position easterly of its <br />present location to match the new street work, or remove the same entire- <br />ly at said grantor's option, grantor to express its choice in this re- <br />spect by a signed statement in writing delivered to the Director of <br />Public Works of City. <br /> <br /> 4. Ivlove the unlighted sign at the extI, eme Southwest corner of the <br />property to a new and appropriate position, agreed upon between grantors <br />and City's agent, on grantor's property. <br /> <br /> ~. Provide for the relocation of the large neon sign to a position <br />east of the new street right-of-way line which is to include the cost <br />of relocating the pole aud all necessary electrical connections thereto. <br /> <br /> 6. That City will complete all of said work within a reasonable <br />time after the work of street ~Adening is c Gnpleted. <br /> <br /> BE IT FURTHER RESOLVED: That Carl J. Thornton, the City's desig- <br />nated agent, is directed to place his Certificate of Acceptance on said <br />deed. <br /> <br /> <br />
