McClay St <br />c: Planning <br /> <br />RESO~TION N0. ~8-~6 GRAy, TING VARIANCE AND IMPOSING <br />CONDITIONS ~OT RECOMM~{DED BY T~ PLANNING CO~MISSION <br /> <br /> WHEREAS, Rodolfo Vega and Mary Vega have filed Variance Appli- <br />cation No. 9~8 requesting permission to place a single family dwelling <br />on the rear of a large lot for use as owner's residence, without the <br />requirement of joining the two st~ctures to have only one building, <br />as required in an R-2 District, and after hearing the Planning Comm- <br />ission recommend ed that the variance be granted under certain con- <br />ditions but did not concur in the conditions recommended by the Depart- <br />ment of Public Works; <br /> <br /> NOW, 'EqEREFORE, after consideration of all matters here involved, <br />it is resolved that said variance is hereby granted to allow the con- <br />struction of a single family dwelling on tee rear part of the lot in <br />accordance wish ~he plot plan on property in the City of Santa Ana <br />described as: <br /> <br /> '~tE ~ST 170.~ feet of Lot ~ of the Home Place, as sho~ on <br /> a map taereof recorded in Book 7, Page 29, Miscellaneous Maps, <br /> Records of said 0range County; excepting therefrom the South <br /> 3 feet, <br /> <br />on the following conditions: <br /> <br /> 1. That the existing room at the rear of the garage in the <br />center of the lot now being used as a residence be removed. <br /> <br /> 2. That no building permit be issued for the proposed new con- <br />struction until the existing second residence has been removed. <br /> <br /> 3. That the broken curb (approximately l0 linear feet) be re- <br />moved and replaced and that expansion material be installed at the <br />sidewalk which abuts the curb. <br /> <br /> 4' ~at the broken sidewalk (approximately ~ square feet) <br /> <br />be removed and replaced at approach. <br /> <br /> BE IT FURTHER RESOLVED: That the Council finds the special cir- <br />cumstances to exist and that special property rights are involved, as <br />set forth in Planning Commission No. 304.0, and finds that material <br />damage will not result to other property in the neighborhood. <br /> <br /> <br />
