L~ma, applicant <br /> <br /> RESOLUTION N0. 58-77 GRANTING VARIANCE A~ND IMPOSING A <br /> CONDITION NOT RECOM~fENDED BY THE PLANNING CO~,~i~,fISSION <br /> <br /> ~HEREAS, on Variance Application No. 976 requesting reductions <br />in side yards from the standard of 4 feet to J feet on the West side, <br />and to 2 feet 6 inches on the East side, and the Planning Commission <br />unanimously reco~tmended that the variance be granted as requested, and <br />apended as one of the conditions, a requirement to improve Eighth <br />Street with side walks, paving, curb and gutter, and <br /> <br /> %k~ZEREAS, the Council after study finds and agrees with the reasons <br />for granting set forth in Planning Commission Resolution No. 3055, bu~ <br />has determined the necessity of requiring a 3 foot side yard along the <br />East of said property, and they do not ~nd that owner should be re- <br />quired to put in imi?rovements as recommended in third condition in <br />said Resolution and by the Department of Public Works. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Variance Application <br /> <br />No. 976 oe granted to allow a variance from the standard side yard <br />requirements from 4 feet to 3 feet along each side of the property <br />described as: <br /> <br /> Beginning at a point 45 ft. east of the northeast corner of <br /> Hickey (Sth) Street and English, as s~ d streets are now es- <br /> tablished, each being 50 ft. in width; thence north parallel <br /> with the east line of English Street, 136 feet; thence east <br /> parallel with the north line of Hickey (8th) Street, 45 feet; <br /> thence south parallel with the east line of English Street, <br /> 136 feet to the north line of Hickey Street; thence west along <br /> s~d last-mentioned line 45 feet to the point of beginning, <br /> <br />on 'the condition that owner dedicate for street purposes that port~on <br />of said property to a point 42 feet, measured at right ~ gles'to the <br />existing center line of Eighth ~treet, along the full frontage of <br />said property, and dedicate all vehicular access rights along the <br />Eighth Street frontage to the City. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa Ana <br /> <br />at its regular meeting held on the <br />ATTEST~ <br /> CLERK OF THE COUNCIL <br /> <br />17th da ~. <br /> <br /> <br />
