IN THE MATTER OF THE ACQUISITION AND IMPROVEMENT <br />DISTRICT NO. 5 OF THE CITY OF SANTA ANA. <br /> <br /> RESOLUTION ORDERING ACQUISITION AND IMPROVEMENT NO. 2129. <br /> <br /> BE IT RESOLVED by the City Council of the City of Santa Aha, that it is <br />hereby found, determined and ordered as follows: <br /> <br /> 1. That the owners of more than one-half of the area of the property <br />included in the Assessment District described in Resolution of Intention No. 2128 <br />In the Matter of ;~cquisition and Improvement District No. O of the City of Santa <br />Ana, adopted by this City Council on the 28th day of August, 1929, and in the <br />specifications therefor referred to in said Resolution, have not made written <br />objections going to the entirety of the things herein proposed to be done; <br /> <br /> 2. That the Ooundaries of the Assessment District for said Acquisition <br />and Improvement District No. 5 as proposed in said Resolution of Intention, are <br />hereby adopted and established as the Doundaries of said Assessment District. <br /> <br /> 3. That the public interest and necessity requires, and it is hereby <br />ordered, that the following acquisition for the opening and extension of Richland <br />Street in the City of Santa Ana be made, to-wit: <br /> <br /> All of a strip of land sixty (60) feet in width and Deing thirty <br /> (30) feet on each ~ide of and adjacent to the following described cente~ <br /> line, to-wit: <br /> <br /> Begin~ing at the Northeasterly corner of Block One (1) of <br /> Hillyard Addition as per map thereof on file in Miscellaneous Maps, <br /> Book 4, Page $2, Records of Orange County, California; thence Westerly <br /> along the Northerly line of Block One (1) of said Hillyard Addition to <br /> the. Northwesterly corner thereof. <br /> <br />All as =et forth and described in said Resolution of Intention No. 2128, passed <br />and adopted August 20, 1929, and in the specifications referr,~d to, and that the <br />property necessary to be taken for such opening and extension of Richland Street, <br />and which is hereby ordered to be acquired therefor, is that described in Section <br />i of said Resolution of Intention. <br /> <br /> ~. That the City Attorney of the City of Santa Ana is hereby ordered <br />to bring an action in the name of the City of Santa Ana, in the Superior Court of <br />the State of California, in and for the County of Orange, for the condemnation of <br />the property necessary to be taken for the acquisition ordered in paragraph <br />hereof, and described in Section I of said ~esolution of Intention No. 2125, and <br />to do all things necessary to prosecute said action to final determination. <br /> <br /> ~. That to defray the expenses of the acquisition herein ordered bonds <br />will be issued to the total amount of the same, said bonds to bear interest at <br />the rate of seven percent per annum, payable semi-annually, and the aggregate <br />principal of all bonds issued to be paid and discharged within thirteen <br />years after the date of issuance, approximately one-tenth of said aggregate <br />principal to be paid annually, all in gold coin, and that a special fund for the <br />payment of said bonds will be constituted by the levy of special assessment t~xes <br />upon the lands within the Assessment District, according to the assessed value <br />Of said lands, exclusive of the improvements thereon, and in the manner provided <br />by the provisions of the sai~. act under which said acquisition proceedings are <br />had and taken, the first payment of the aggregate principal on the bonds issued <br />will be made three years after the issuance thereof. <br /> <br /> 8.
