RESOLUTION NO. 20VV <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SANTA ANA, CALIFORNIA, RELATING TO THE ISSUANCE <br /> OF STREET IMPROVEMENT BONDS PURSUANT TO RESOLUTION <br /> OF INTENTION NO. 1990; DETERMINING THE AMOUNT OF <br /> UNPAID ASSESSMENTS; PRESCRIBING THE DENOMINATION <br /> OF 8NCH BONDS AND PROVIDING FOR THEIR ISSUANCE IN <br /> ANNUAL SERIES: <br /> <br /> WHEREAS, pursuant to Statute, notice of the filing of list of unpaid <br />assessments was duly given in the manner and form required by law, that the <br />warrant, assessment and diagram was recorded on the 29th day of January, 1929, <br />for the work and improvement made by Griffith Company, under that certain con- <br />tract awarded to it on the lVth day of September, 19~8, upon a portion of Palm <br />Avenue, as set forth in Resolution of Intention No. 1990; and that said warrant, <br />assessment and diagram were returned to the Street Superintendent of said City, <br />together with a written statement of all payments received upon the said assess- <br />ment; and after thefull expiration of thirty (30) days after the date of record- <br />ing of said warrant, the said Street Superintendent duly made and filed with the <br />City Clerk of said City of Santa Asa, a complete list of all assessments unpaid <br />upon the said assessment, which list is now on file in the office of the City <br />Clerk of said City; now upon evidence shown, this City Council determines that th~ <br />assessments therein mentioned were then unpaid, the total aggregate thereof being <br />the sum of Nine Thousand, Two Hundred Twenty-two and 57/100 Dollars ($9,2S~.37), <br />and that no assessments have been paid since the filing of the list of unpaid <br />assessments by the Street Superintendent, and that there now remains unpaid the <br />sum of Nine Thousand Two Hundred Twenty-Two and 3V/lO0 Dollars ($9,B2~.3V), upon <br />the assessments shown upon said list. <br /> <br /> Reference is hereby made to Resolution of Intention No. 1990 of the <br />City Council of the City of Santa Ana, passed on the 8th day of August, 19~8, for <br />a complete description of the work herein mentioned, and to the list of m~paid <br />assessments filed as above stated for the assessments unpaid; and <br /> <br /> WHEREAS, interested persons, were notified in the manner required by law <br />to appear before the City Council in the Council Chamber of the City Hall of said <br />City at the hour of 7:30 o~clock P.~. on Monday, the llth day of March, 19S9, and <br />show cause, why bonds should nQt be issued upon the security of the unpaid assess. <br />ments shown on the Street Superintendent~s list; and <br /> <br /> ¥~H]EREAS, notice was duly given in the manner and form required by law, <br />that serial bonds to represent unpaid assessments bearing interest at the rate of <br />six per cent per annum will be issued hereunder in the manner provided in the <br />"Improvement Bond Act of 1915", the last installment of which bonds shall mature <br />nine years from the ~nd day of July, next succeeding ten (10) months fr~n their <br />date, and all interested persons having appeared before this City Council and <br />having been given a full opportunity to show cause why bonds should not be issued <br />upon the security of the unpaid assessments shown on said list, and all objection~ <br />presented havinE been heard and considered. <br /> <br /> IT IS THEREFORE NO~ BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, <br />DETERMINED, RESOLVED AND ORDERED AS FOLLOWS: ~z~at no cause has been shown why <br />bonds should not be issued upon the security of said unpaid assessments, and <br />does hereby overrule all objections thereto, and does hereby direct the issuance <br /> <br /> <br />
