RESOLUTION NO. 2095 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SANTA ANA, ~ALIFORNIA, RELATING TO THE ISSUANCE <br /> OF STREET IMPROVEMENT BONDS, PURSUANT TO <br /> RESOLUTION OF INTENTION NO. 2025; DETERMINING THE <br /> AMOUNT OF UNPAID ASSESSMENTS; PRESCRIBING THE <br /> DENOMINATION OF SUCH BONDX AND PROVIDING FOR THEIR <br /> ISSUANCE IN ANNUAL SERIES. <br /> <br /> ~PLEREAS, pursuant to Statute, notice of the filing of llst of unpaid <br />assessments was duly given in the manner and form required by law, that the <br />warrant, assessment and diagram was recorded on the 18th day of April, 1929, for <br />the work and improvement made by Steele Finley, under that certain contract <br />awarded to him on the 10th day of December, 1928, upon Birch Street from the <br />center line of Fairview Avenue to the North line of Tract No. 352, and Russell <br />Avenue from the West line of Broadway to the East line of Ross Street, as set <br />forth in'Resolution of Intention No. 2025; and that said warrant, assessment <br />and diagram were returned to the Street Superintendent of said City, together <br />with a w~itten statement of all payments received upon the said assessment; and <br />after the full expiration of thirty (30) days after the date of recording of said <br />warrant, the said Street Superintendent duly made and filed with the City Clerk <br />of said City of Santa Ana, a complete list of all assessments unpaid upon the <br />said assessment, which list is now on file in the office of the City Clerk of <br />said City; now u~pon evidence shown, this City Council determines that the assess- <br />ments therein mentioned were then unpaid, the total aggregate thereof being the <br />sum of Seventeen Thousand Seven Hundred Twenty-eight and 80/100 Dollars ($17,V28.( <br />and that no assessments have been paid since the filing of the list of unpaid <br />assessments by the Street Superintendent, and that there now remains unpaid the <br />sum of Seventeen ~%ousand Seven Hundred Twenty-eight and 80/100 Dollars <br />($17,728.80), upon the assessments shown upon said list. <br /> <br /> Reference is hereby made to the Resolution of Intention No. 2025 of <br />the City Council of the City of Santa Ana, passed on the 22nd day of October, <br />1928, for a complete description of the work herein mentioned, and to the list <br />of unpaid assessments filed as above stated for the assessments unpaid; and <br /> <br /> WHEREAS, interested persons were notified in the manner required by <br />law to appear before the City Council in the Council Chamber of the City Hall of <br />said City at the hour of 7:30 o'clock PLM. on Monday, the 27th day of May, 1929, <br />show cause, why bonds should not be issued upon the security of the unpaid <br />assessments shown on the Street Superintendent's list; and <br /> <br /> WHE]LEAS, notice was duly given in the manner and form required by <br /> <br />law, that serial bonds to represent unpaid assessments bearing interest at the <br />rate of six per cent per annum will be issued hereunder in the manner provided <br />in the "Improvement Bond Act of 191S", the last installment of which bonds <br />shall mature nine years from the 2nd day of July next succeeding ten (10) <br />months from their date; and all interested persons having appeared before this <br />City Council and having been given a full opportunity to show cause why bonds <br />should not be issued upon the security of the unpaid assessments sho~m on said <br />list, and all objections presented having been heard ~nd considered. <br /> <br /> IT IS THEREFORE NOW BY TI~ CITY COUNCIL OF THE CITY OF SANTA ANA <br />DETERMINED, RESOLVED AND ORDERED AS FOLLOWS: That no cause has been shown why <br />bonds should not be issued upon the security of said unpaid assessments, and <br />does hereby overrule all objections thereto, and does hereby direct the issuance <br /> <br /> <br />
