RESOLUTION NO. 2159. <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SANTA ANA, CALIFORNIA, RELATING TO THE ISSUANCE <br /> OF STREET IMPROVENENT BONDS, PURSUANT TO <br /> RESOLUTION OF INTENTION NO. 2109; DETERMINING THE <br /> AMOUNT OF UNPAID ASSESSMENTS, PRESCRIBING THE <br /> DENOMINATION OF SUCH BONDS; AND PROVIDING FOR <br /> THEIR ISSUANCE IN ANNUJ~L SERIES. <br /> <br /> V~EREAS, pursuant to Statute, notice of the <br /> <br /> was duly given in the manner and form required by law, <br /> diagram was recorded on the '3rd day of December, 1929, <br /> by Griffith Company, under t~at certain contract awarded to it on the 19th day of <br /> Au&~st, 1929, upon portions of Grand Avenue and East Second Street, as set forth in <br /> Resolution of Intention No. ~109; and that said warrant, assessment and diagram were <br /> <br /> returned to the Street Superintendent of said City, together with a written statement of <br /> <br />all pavements received upon the said assessment; and after the full expiration of thirty <br /> (30) days after the date of recording of said warr~nt, the said Street Superintenda~t <br /> duly made and filed with the City Clerk of said City of Santa Ana, a complete list of all <br /> assessments unpaid upon the said assessment, which list is now on file in the office of <br /> the City Clerk of said City; now upon evidence shove, this City Council determines that <br /> the assessments therein mentioned were then unpaid, the total aggregate thereof being the <br /> sum of Six Thousand Three Hundred Seventy-three and 45/100 Dollars ($6,373.45), and that <br /> no assessments have been paid since the filing of the list of unpaid assessments by the <br /> Street Superintendent, and that there now remains uhpaid the sum of Six Thousand Three <br /> Hundred Seventy-three and 45/100 dollars ($6,373.45) upon the assessments sho~vn upon said <br /> list. <br /> <br /> Reference is hereby made to Resolution of Intention No. 2109 of the City <br /> Council of the City of Santa ~na, passed on the 15th day of July, 1929, for a complete <br /> description of the work herein mentigned, and to the list of unpaid assessments filed as <br /> above stated for the assessments unpaid; and <br /> <br /> WHEREAS, interested persons were notified in the manner required by law to <br /> appear before the City Council in the Council Chamber of the City Hall of said City at th~ <br /> hour of 7:30 o~clock P.M. on Monday, the 20th day of January, 1930, and show cause why <br /> bonds should not be issued upon the security of the unpaid assessments shown on the <br /> Street Superintendent,s list; and <br /> <br /> WHEREAS, notice was' duly given in the manner and form required by law, that <br />serial bonds to represent unpaid assessments bearing interest at the rate of six percent <br />per annum, will be issued hereunder in the manner provided in the "Improvement Bond Act <br />of 1915", the last installment of which bonds shall mature nine years from the 2nd day of <br />July, next succeeding ten ~lO) months from their date, and all interested persons having <br />appeared before this City Council and having been given a full opportunity to show cause <br />why bonds should not be issued upon the security of the unpaid assessments shown on said <br />list, and all objections presented having been heard and considered. <br /> <br /> IT IS THEREFORE NOW BY THL~ CITY COUNCIL OF THE CITY OF SANTA ANA, DETERMINED, <br />RESOLVED AND 0RD~RED AS FOLLOWS: That no cause has'been shown why bonds should not be <br />issued upon the security of said unpaid assessments, and does hereby overrule all object- <br />thereto, and does hereby direct the issuance of said bonds; and further, <br /> <br />BE IT RESOLVED AS FOLLOWS: That bonds shall be issued upon the security of <br />said unpaid assessments to said amount of Six Thousand Three Hundred Seventy-three and <br /> <br />filing of list of unpaid assessment <br />that the warrant, assessment and <br />for the work and improvement made <br /> <br /> <br />
