<br /> RESOLUTION ORDERING THE ISSUANCE OF BONDS TO
<br /> (~TAIN IM~[EDIATE POSSESSION
<br />
<br /> V~EREAZ, in a Resolution adopted by tH City Council of the City of
<br />Santa Aha, on the 25th day of November, 1929, the acquisition of lands required
<br />for the opening of Santa Aha Boulevard from ~iain Street to Chapman Avenue~ the
<br />extension of North Broadway from its present Northerly limits across the right
<br />of way of the Southern Pacific i%ailroad Corapany, and intersecting the said Santa
<br />Aha Boulevard, and the widening of Flower Street from Santa Clara Avenue to
<br />
<br />Santa Ana Boulevard, to make said street a uniform width of eighty (80) feet, all
<br />of said streets being public streets in said City of Santa Aha, as proposed in
<br />Resolution of Intention No. 2142 in the above entit!ed matter, adopted on the 4th
<br />day of November, 1929, was ordered, and the City Attorney of the City of ~anta An~
<br />was directed to bring an a~tion for the condemnation of the property necessary
<br />therefor, and to report to this City Council the amounts of money required for th~
<br />purpose of obta%ning immediate possession and use of the property so ordered to b~
<br />acquired, upon complying with the requirements of the law applicable thereto; and
<br />
<br /> V~EREAS, said City Attorney on the 27th day of November, !929, reported
<br />to this City Council that an action in eminent domain had been filed in the
<br />Superior Court of the State of California, in and for the County of Orange, said
<br />action being entitled "City of Santa Aha, a Municipal Corporation of the Fifth
<br />Class, Plaintiff, vs. Restop Realty Realty Company, et al, Defendants", being
<br />Superior Court case No. 26373, and that proof was presented to said Court of the
<br />amounts of money adequate to secure to the owners of property sought to be
<br />condemned, and of any estate therein, the immediate payment of just compensation,
<br />as soon as the same can be ascertained, according to law, and that the said Court
<br />made an order directing the deposit of money to secure such payment of eompensati¢
<br />to the defendants in said action, and that the total amount required be deposited
<br />in Court in order to obtain i~nediate possession of said property as set forth in
<br />said Order of Court was the sum of Forty-three thousand five hundred twenty-five
<br />dollars (~43,525.00); and

<br /> '?.~EREAS, on the 29th day of November, 1929, the said City Council advan¢
<br />such amounts as were required by the Court to be deposited to obtain such
<br />immediate possession and use from the General Fund of said City, being in the
<br />total amount Of forty,three thousand five hundred twenty-five dollars
<br />and
<br />
<br /> ~LEREAS, at its meeting held on the 20th day of January, 1930, the City
<br />Council of said City fixed a day, hour and place for a hearing upon the issuance
<br />of bonds against the lands in the Assessment District in Acquisition and Improve-
<br />ment District No. ~ of the City of Santa Ana, for the purpose of obtaining the
<br />amounts required by the Court, to-wit: Amounts totaling the sum of forty-three
<br />thousand five hundred twenty-five dollars ($~S,$28.00), to reimburse the Treasury
<br />of said City for the moneys so advanced and deposited in Court, in order that
<br />immediate possession and use of the public ways sought to be acquired under the
<br />proceedings in the above entitled matter might be had, and for the purpose of
<br />furnishing an opportunity to all persons o~wning lands within said Assessment
