RESOLUTION NO. 2172 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA AMA, <br /> CALIFO~IA, RELATING TO THE ISSUANCE OF STREET IMPROVEMENT <br /> BONDS PURSUANT TO RESOLUTION OF INTkNTIO;! NO. 2~13; DETER- <br /> MINING THE AMOUNT OF UNPAID ASSESS~NTS; PRESCRIBING THE <br /> DENOMINATION OF SUCH BONDS AND PROVIDING FOR THEIR ISSUANCE <br /> IN ANNUAL SERIES. <br /> <br /> WHEREAS, pursuant to Statute, notice of the filing of list of unpaid <br /> assessments was duly given in the manner and form required by law, that the warra <br /> assessment and diagram was recorded on the 21st day of J~nuary, 1950, for the <br /> work and improvement made by Wells and Bressler, uuder that certain contract <br /> awarded to them on the 5rd day of September, 1929, upon portions of Ross Street <br /> and Santa Clara Avenue, as set forth in Resolution of Intention No. 211G; and <br /> that said warrant, asse~zaent and diagram were returned to the Street Superintend- <br /> ent of said City, together with a v~itten statement of all payments received <br /> u~on the said assessment; and after the full expiration of thirty (~0) days after <br /> the date of recording ~f said warrant, the said Street Superintendent duly made <br /> and filed with the City Clerk of said City of San~a Ana~ a complete list of all <br /> assessments unpaid upon the said assessment, which list is now on file in the <br /> office of the City Clerk of said City; now upon evidence shown, this City Council <br /> determines that the assessments therein mentioned were then unpaid, the total <br /> aggregate thereof being the sum of Thirteen Thousand Two Hundred Fourteen Dollars <br /> ($1~,21~.00), And that there has beep paid since the filing of the list of unpaid <br /> assessments by the Street Superintendent the following assessment, to-wit: <br /> Assessment No. 55 for ~85.95, and ~hat there now remains unpaid the sum of <br /> Thirteen Thousand One Hundred Forty-eight and 05/100 Dollars ($1S,l~8.0S) upon <br /> the assessments shown upon said list. <br /> <br /> R~ference is hereby made to Resolution of Intention No. 211G of the <br /> City Council of th~ City of Santa Ana, passed on the 22nd day of July, 1929, for <br /> a complete description of the work herein mentioned, and to the list.of unpaid <br /> assessments filed as above stated for the assessments unpaid; and <br /> <br /> WHEREAS, interested persons were notified in the manner required by law <br />to appear before the City Council in the Council Chamber of the City Hall of said <br />City at the hour of 7:~0 o~ctock P.M. on Monday, the 8rd day of March, 19~0, and <br />show cause why bonds should not be issued upon the security of the unpaid assess- <br />ments shown on the Street Superintendent~s list; and <br /> <br /> %~HEREAS, notice w~s duly given in the manner and form required by law~ <br />that serial bonds to represent unpaid assessments bearing interest at the rate of <br />six percent per anmlmwill be issued hereunder in the manner provided in the <br />"Improvement Bond Act of 1915", the last installment of which bonds shall mature <br />nine years from the 2nd day of July next succeeding ten (10) months from their <br />date, and all interested persons having appeared before this City Council and <br />having been given a full opportunity to show cause why bonds should not be issued <br />upon the security of the unpaid assessments shown on said list, and all object- <br />ions presented having been heard and considered. <br /> <br /> IT IS THEREFORE NOW BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, <br />DETER~INED, RESOLVED AND 0RD~RED AS FOLLOWS: <br /> <br /> That no cause has been shown why bonds should not be issued upon the <br /> <br /> <br />
