176 <br /> <br /> Ii~ THE M~TTER OF ACQUISITION AND I~PROVE~ENT <br /> <br /> DISTRICT NO. 9, OF THE CITY OF SANTA ANA <br /> <br /> RESOLUTION NO. 2285. <br /> <br /> RESOLUTION PASSING UPON PROTESTS AND OBJECTIONS <br /> <br /> Wi~REAS, this City Council adopted its Resolution of Intention In the <br /> ~atter of Acquisition and Improvement District No. 9 of the City of Santa Ana on <br /> the 24th dayof November, 1950, and at the. time and place fixed therein for the <br /> hearing of any and all objections or protests, which, under the provisions of the <br /> "Acquisition and Improvement Act of 1925" can be presented to this Legislative <br /> Body, took up the matter of hearing the same; and <br /> <br /> ~EREAS, at a time not later than the hour set for said hearing certain <br /> owners of land within the boundaries of said Assessment District, as the same are <br /> set forth in said Resolution of Intention, filed with the Clerk of this Legislati~ <br /> Body written objection to the doing of the thing or things in said Resolution of <br /> Intention proposed to be done in their entirety, and to the ordering of the same, <br /> and. certain objections written and oral having been made to the doing of the said <br /> things so proposed to be done and to the grades to which said improveraents are <br /> proposed to be constructed and to the extent of the Assessment District; and <br /> <br /> ~HEREAS, careful consideration has been given the said objections and <br /> protests, and an opportunity has been afforded to all persons desiring~to be <br /> heard thereon, and a full, fair and impartial hearing upon the entire matter has <br /> been had and evidence has been received relative to the areas of property <br /> represented in th8 written protests filed and upon the other matters objected <br /> to, <br /> <br /> NOM, THEREFORE, BE IT RESOLVi~), by the City Council of the City of Santa <br /> Ana, that it is hereby found, determined and ordered as follows: <br /> <br /> 1. That tile owners of more than one-half of the area of the property <br />inctuded within the entire Assessment District as ~escribed in the Resolution of <br />Intention heretofore ~dopted in this matter on the ~4th day of November, 1900, and <br />in the specifications therefor referred to in said ~esolution, have not made <br />written objections going to the entirety of the tilings therein proposed to be <br />done~ <br /> <br /> ~. That all of the protests and objections, both written and oral, <br />against the doing of the thing or things proposed to be done in said Resolution of <br />Intention are hereby overruled and denied. <br /> <br /> $. That the boundaries of the Assessment District for said ~cquisitton <br />and Improvement District No. 9 of the City of Santa Ana as proposed in said <br />}{esolution of Intention are hereby adopted and established as the boundaries of <br />said Assessment District. <br /> <br /> 4. That the grades to which said improvements and work are to be con- <br />structed as finally determined hereby are those set forth in the plans and spec- <br />ifications, and referred to in Resolution of Intention No. ~80. <br /> <br /> I hereby certify that the foregoing Resolution was regularly introduced, <br />passed and adopted by the City Council of the City of Santa Ana, at a regular meet- <br />ing held on the 19th day of January, 1951, by the following vote of the members <br />thereof, to-wit: <br /> <br /> <br />
