RESOLUTION NO. 59-255 REQUESTING THE ATTORNEY GENERAL OF <br />THE STATE OF CALIFORi~FIA TO INVESTIGATE CERTAIN PUBLICATIONS <br />TO DETER~.JIIiIE ~VHE~tER OR NOT THE SA~,~E ~L~_~_~ BE IN VIOLATION <br />OF SECTION 311 OF ~tE PENAL CODE 0F THE STATE OF CALIFOPd~IA <br /> <br /> WHEREAS, for the past several weeks Citizens' Committees have <br />been meeting in the City of S~ta Ana discussing and considering <br />means of regulating certain low-grade publications offered for sale <br />on the City's news stands, which said publications may be in viola- <br />tion of State Statute; <br /> <br /> WHEREAS, these Citizens' Committees have requested the City <br />Council of the City of Santa Ana to consider an Ordin~ce to prohib- <br />it certain publications as obscene and indecent, and the members of <br />said City Council have been in doubt as to the possible validity <br />of any such Ordinance because of conflict which might exist between <br />such local~0rdinance and Section 311 of the Penal Code of the State <br />of California; <br /> <br /> NOW, THEREFORE, BE IT RESOLV]ED: That the City Council of the <br /> City of Santa Ana requests that the Attorney General of this State, <br /> being the chief State law enforcement officer, take immediate steps <br /> to investigate the magazine type publications not distributed under <br /> a United States Post Office Second-Class Hailing Permit, but pub- <br /> lished and sold to children, and to adults with immature minds, <br /> particularly publications as follows: <br /> <br /> 1. Sprite Publishing Co., 1722 E. ~ashington Blvd., Los Angel- <br /> es 24, Vol. l, ~o. 1 <br /> <br /> 2. Cloud 9, published by Valley Publications, Inc., 12969~ <br /> Ventura Boulevard, Shermm Oaks, Calif, Vol. No. 2 <br /> <br /> Rascal, Item No. l, published by Art Enterprises, 8511 <br /> Sunset Blvd., Los Angeles, California. <br /> <br /> to determine whether or not such publications violate Section 311 <br /> of the Penal Code of the State of California. <br /> <br /> BE IT FURTHER RESOLVED: That tAe Clerk of the Council is <br /> hereby instructed to forward two certified copies of this Resolution <br /> to the Attorney General of the State of California. <br /> <br /> <br />
