RESOLUTION NO. 59-255 REQUESTING THE ATTORNEY GENERAL OF THE STATE OF CALIFORi~FIA TO INVESTIGATE CERTAIN PUBLICATIONS TO DETER~.JIIiIE ~VHE~tER OR NOT THE SA~,~E ~L~_~_~ BE IN VIOLATION OF SECTION 311 OF ~tE PENAL CODE 0F THE STATE OF CALIFOPd~IA WHEREAS, for the past several weeks Citizens' Committees have been meeting in the City of S~ta Ana discussing and considering means of regulating certain low-grade publications offered for sale on the City's news stands, which said publications may be in viola- tion of State Statute; WHEREAS, these Citizens' Committees have requested the City Council of the City of Santa Ana to consider an Ordin~ce to prohib- it certain publications as obscene and indecent, and the members of said City Council have been in doubt as to the possible validity of any such Ordinance because of conflict which might exist between such local~0rdinance and Section 311 of the Penal Code of the State of California; NOW, THEREFORE, BE IT RESOLV]ED: That the City Council of the City of Santa Ana requests that the Attorney General of this State, being the chief State law enforcement officer, take immediate steps to investigate the magazine type publications not distributed under a United States Post Office Second-Class Hailing Permit, but pub- lished and sold to children, and to adults with immature minds, particularly publications as follows: 1. Sprite Publishing Co., 1722 E. ~ashington Blvd., Los Angel- es 24, Vol. l, ~o. 1 2. Cloud 9, published by Valley Publications, Inc., 12969~ Ventura Boulevard, Shermm Oaks, Calif, Vol. No. 2 Rascal, Item No. l, published by Art Enterprises, 8511 Sunset Blvd., Los Angeles, California. to determine whether or not such publications violate Section 311 of the Penal Code of the State of California. BE IT FURTHER RESOLVED: That tAe Clerk of the Council is hereby instructed to forward two certified copies of this Resolution to the Attorney General of the State of California.
