RESOLUTION NO. 59-268 AUTHORIZING CONDEMNATION OF <br />CERTAIN REAL PROP~ ON THE WEST SIDE OF FAIRVIEW <br />AVENUE AT EDINGER STREET FOR STORM DRAIN PURPOSES <br /> <br /> WHEREAS, new street alignment for Fai~view North of Edinger <br />street has been established, and in order that the property lying <br />north of Edinger Street may have a storm drain outlet to Edtnger <br />Street, it is necessary to construct a drainage ditch or ur~erground <br />storm drain in the area hereinbelow described; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana finds, declares and orders: <br /> <br /> 1. That public interest and necessity require the acquis- <br />ition of an easement for the installation of a structure to handle <br />storm, flood and surface runoff waters across the real property <br />hereinbelow described. <br /> <br /> 2. That said proposed improvement is located and planned <br />in a manner that will be most compatible with the greatest public <br />good and the least private injury. <br /> <br /> 3- That an action in eminent domain be filed to take and <br />acquire an ease~Gent for said purpose over, in and through that cer- <br />tain real property in the City of Santa Ana, County of Orange, <br />State of California, described as follows: <br /> <br /> That portion of the following described property lying <br /> South of a line parallel with and 800.00 feet Southerly, <br /> measured at right ang]s s from the North line of Section <br /> 22, Township 5 South, Range l0 West, San Bernardino Base <br /> and Meridian: <br /> <br /> A strip of land 30 feet in width the West line of which <br /> is 77 feet westerly, measured at right angles, from the <br /> following described line: <br /> <br /> Commencing at the intersection of the center line of <br /> Sullivan Street with the center llne of Edinger Street <br /> as shown on a map of Tract No. 506, recorded in Book 17~ <br /> pages 26 and 27, Miscellaneous Maps, Records of Orange <br /> County, California, and runninK thence North 0 47 20 <br /> West 10.00 feet; thence South 89° 30' 00" West 875.35 feet <br /> to the beginning of a tangent curve concave northerly <br /> having a radius of 1,200.00 feet; thence westerly along <br /> the arc of said curve through a central angle of ll° 27' <br /> 24", an arc distance of 239.95 feet to the true point of <br /> beginning, said true point of beginning being the inter- <br /> section of the new center line of Edinger Street with the <br /> center line of Fairview Street as it extends North of said <br /> Edinger Street; thence North 15° 48, 38" East 247.06 feet <br /> <br /> <br />
