SECTION 24: VACANCIES IN THE POLICE DEPARTMENT <br /> <br /> Whel~ever a vaCancy in the Police Department, above the grade of patrolman and motorcycle officer, occurs, <br />the Chief of the Police Department may assign a member of the Department from the next ,low,e.r,,r,an~ to fill .the <br />vacancy until such time as the absent member shall return to duty, or the vacancy may ne llllen ny appoint- <br />ment from the eligible llst furnished by the Civil Service Board. The member so assigned shall, during his in- <br />cumbency, receive the salary attached to the grade or position thus temporarily filled. <br /> SECTION 25: <br /> No officer or member o£ the Fire Department or Police Department shall, without the consent of their re- <br />spective Chief or the City Council, accept any money, gratuity or compensation for any service he may render in <br />line of duty as a member of that department. <br /> SECTION 26: <br /> If any section, subsection, clause, or phrase o£ this ordinance is for any mason held to be unconstitutional, <br />such decision shall not affect the validity of the remaining sections of this ordinance. <br /> SECTION 27: <br /> Any provisions or clauses of the several ordinances of the City of Santa Ana in conflict herewith are here- <br /> by expressly repealed. <br /> SECTION 28: <br /> Whenever in t.his ordinance the masculine gender is used it shall be deemed to include the feminine ~ender. <br /> SECTION 29:FALSE MARKING, GRADING, ETC., PROHIBITED <br /> No person shall, by himself or in cooperation with one or more persons, cheat, deceive, or obstruct any <br /> person in respect of his right of examination or registration according to the rules and regnlations of this ordi- <br /> nance~ or falsely mark, grade, estimate or report upon the examination of proper standing of any person ex- <br /> amined, registered or certified pursuant to the provisions of this ordinance, or aid in so doing, or make any <br /> false representation concerning the same, or concerning the person examined. <br /> SECTION 30:AMENDMENTS OF THIS ORDINANCE <br /> The City Council may from time to time, by ordinance, add additional departments, appointive officers or <br /> employees of the City to the list originally designated in this ordinance creating a system of Civil Service. The <br /> City Council however, shall not have the authority or power to withdraw any department or departments, appoin- <br /> tive officers or employees from the operation of the system created by this ordinance, unless and until the with- <br /> drawal thereof shall have been submitted to the qualified electors of the City of Santa Aha at a special or regular <br /> municipal election held in said City, and shall have been approved by not less than a two-thirds vote o[ the elec- <br /> tors voting on such proposition. <br /> SECTION 31: VIOLATION OF THIS ORDINANCE A MISDEMEANOR <br /> Any person who shall violate any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, <br /> end upon conviction thereof, shall be punished by a fine of not not less then One Hundred ($100) Dollam or <br /> mere than Three Hundred ($300) Dollars; or by imprisonment in the County Jail for not longer than three (3) <br /> months, or by both such fine and imprisonment. <br /> <br /> <br />
