<br />RESOLUTION CONCERNING TAX-DE~D~) LANDS AND
<br />REPLACING SAME ON TAX ROLLS (THIRD TAX SALE)
<br />
<br /> WHEREAS, Section 3897d of the Political Code of the State of California, as
<br />amended, provided among other things, that whenever any property has been deeded for
<br />delinquent taxes and/or assessment~ to the State of California, and said property is
<br />subject to a lien which constitutes a de~d, under sections 5897.3 and 5897d of the
<br />Political Code, for delinquent taxes and/or or assessments to any municipality, and
<br />such lien has been in existence for at least five years, the governing body of said
<br />municipality may enter into an agreement with the Board of Supervisors in the County
<br />in which said property is situated, subject to the ~proval of the State Controller,
<br />for the purchase of, or for the option to purchase the property so held by the ~tate,
<br />or any part or parts thereof; and
<br />
<br /> WHEREA~, all of the One Hundred eight~-nine (189) lots or parcels of propert'
<br />hereinafter mentioned and described in Exhibit'A" hereto attached, are wholly within
<br />the City Limits of the City of Santa Ana, in the County of Orange, State of California
<br />and are now delinquent for city taxes and for county taxes, or for public improvement
<br />assessments of the City of Santa Aha, and further, all of said lots or parcels of land
<br />hereafter described in Exhibit "A" aforesaid, have been deeded to the State of
<br />California, for non-payment of County taxes, and are subject to a lien for delinquent
<br />taxes and/or assessments of the City of Santa Aua, which has been in existence for
<br />at least five years, and has not been paid; and which lien constitutes a deed for
<br />delinquent taxes within the meaning of Sections 3897d and 3897.3 of the Political Code
<br />and
<br />
<br /> WHEREAS, there has this day been presented to the City Council of the City
<br />of Santa Aha a plan marked Exhibit "C" dated September 1st, 1958, under which it is
<br />expected to return to the City tax rolla, and to the County tax rolls all that certaiz
<br />real property situated in the City of Santa Aha, County of Orange, State of California
<br />and being more particularly described and set forth in Exhibit "A" hereto attached
<br />and made a part hereof; and
<br />
<br /> WHEREAS, there has also been presented to the City Council of the City of
<br />Santa Aha, an agreement, a copy of whichis annexed and marked Ex~ibl~ "B", dated
<br />the 6th day of September, 1938, wherein the Board of Supervisors of the County of
<br />Orange, State of California, acting under the authority granted to it by Section
<br />5897d of the Political Code of the State of California, therein designated as the
<br />~eller, and the City Council of the City of Santa Aha, acting under the authority
<br />~ranted to it by Sections ~897d and 389V.5 of the Political Code of the State of
<br /> alifornia, is designated as the Buyer, wherein the said Buyer agrees, among other
<br />things, to purchase said delinquent tax lots heretofore mentioned and more particularlN
<br />described in said agreement, for the sum of One H~udred Eighty-nine ($189.00) Dollars
<br />cash, lawful money of the United States of America, said agreement, however, to be
<br />subject to the approval of the State Controller of said St~ e, and subject and pursuan~
<br />in all respects to Sections 589Vd and 3897.3 of the Political Code of the State of
<br />California.

<br /> NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Santa
<br />Aha approves the Plan No. 3, dated the 1st day of September, 1938, submitted to it for
<br />the purpose of placing said delinquent tax property back on the tax rolls of the
<br />City of Santa Aha and the County of Orange, and orders the same to be attached to this
<br />resolution and filed as a permanent record with the City Clerk of the City of Santa
<br />Aha, and
<br />
<br /> BE IT FURTH~ RESOLVED, that the City Council of the City of Santa Ana by
<br />reference thereto, makes said plan and the whole thereof, a part of this resolution
<br />to the same extent and purpose as if the same were herein set out in full; and
<br />
<br /> BE IT FURTHER RESOLVED, that the agreement heretofore mentioned be, and the
<br />same is hereby approved as written, and the Mayor of the City of Santa Aha, and the
<br />City Clerk of said City are hereby authorized and directed to sign and execute the
<br />same on behalf of the City of Santa Aha, and the Clerk is directed and instructed to
<br />deliver a duly executed copy thereof to the Seller therein named.

<br /> PASSED AND ADOPTED by the City Council of the City of Santa Aha at its
<br />regular adjourned meeting held on the 6th day of September, 1958.
