"The facts constituting such necessity are as follows: Due to the depression which has existed in the past several years, many landowners have been unable to meet the taxes and assessments levied by the State, political subdivisions agencies, reclamations, drainage and levee districts, with the result that their lands have been sold to the State and such taxing and assessing agencies. The heavy penalties assessed by law have made it impossible for the landowners to redeem their lands, hence thousands of acres of land (together with thousands of lots,) have been sold for the non-payment of such taxes and assessments, and deeds have been executed thereon to the State and such taxing and assessing agencies. That as long as such' lands (or LotsJ remain State lands, the same are non-assessable for tax or assessment purposes, and the tax and assessment burden becomes heavy upon the paying lands, causing more delinquencies ~nd losses***. The legislature hereby declares that the welfare of the State requires that such lands (or lots) be placed in private ownership as premptly as possible so that such land (or lots) henceforth bear its Just proportion of current taxation and assessments". AGRE~T OF SALE AND PURCHASE THIS AGBI~EMENT made this 6th day of September, 1938, by and between the BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE, STATE OF CALIFORNIA, acting under the Authority granted to it by Sections 389Vd~nd 389V.3 of the Political Code of said State, hereinafter designated as "Seller", and the CITY COUNCIL OF THE CITY OF SANTA ANA, a municipal Corporation of the Fifth Class, of the State of California, herein- after designated as "Buyer"; WI TNESSETH THAT WHEREAS, each and every parcel of the property desmribed an the schedul hereto attached, marked Exhibit "A", and made a part hereof, has been deeded for delinquent taxes and/or assessments to the State of Califomia and is also subject to a lien which constitutes a deed, under Sections 3897.3 sn~ 3897d of the Political Co~e of the State of California, for delinquent taxes and/or assessments to said Buyer, such llen having been in existence for ~ least five years; and WHEREAS, there is shown on said Exhibit "A", the dates and the deed numbers under which said properties were deeded for non-payment of taxes, to the State of California; NOW, THEREFORE, subject to the approval of the State Controller of said State and subject and pursuant in all respects to said Sections 389Vd and 3897.3 of the Political Code, said Seller does hereby agree to sell and said Buyer does hereby agree to purchase all of th eproperty shown on and described in said Exhibit "A" for the sum of ONE HUNDRED, EIGnT~NIh~ ($189.00) DOLLARS, payable as follows: Cash upon delivery of a deed for said property from the County Tax Collector. Seller agrees to cause its Tax Collector to execute and deliver to Buyer a Deed for said property as provided in said Section 3897d of the Political Code of Call fornia. Time is hereby declared to be the essence of this agreement. IN WITNESS WHEREOF, this instrument is executed for Seller by its Chairman and Clerk by resolution thereunto duly authorized, and for the Buyer, by its Mayor and Clerk, by resolution thereunto duly authorized, certified copies of said resolutions being attached to this agreement.
