RESOLUTION 64-2 OVERRULING THE PLANNING <br />COMMISSION AND GRANTING CONDITIONAL USE <br />PERMIT NO. 154 FILED BY MATHILDA N. KANE <br />SUBJECT TO CONDITIONS <br /> <br /> WHEREAS, after hearing on notice, the Planning Commission <br />denied Conditional Use Permit NO. 154 filed by MATHILDA N. KANE to <br />convert a portion of a single family residence located at 709 North <br />Mountain View Street in the City of Santa Aha for the care of six <br />retarded children; and <br /> <br /> WHEREAS, Appeal Application No. 114 was duly filed by said <br />applicant requesting a hearing on said Conditional Use Permit before <br />the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that the Planning C~L,ission should be overruled and <br />that said Conditional Use Permit should be granted subject to <br />certain conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the decision of the <br />Planning C~m,ission is hereby overruled and that Conditional Use <br />Permit No. 154 is hereby granted to MATHILDA N. KANE to permit the <br />conversion of a single family residence located at 709 North Mountain <br />View Street in the City of Santa Ana, in an R-1 District, for the <br />care of six mentally retarded children. Said Conditional Use Permit <br />is granted subject to conditions as follows: <br /> <br />That the total occupancy of the residence at 709 North Mountain <br />View Street be limited to not more than six (6) handicapped <br />children and the immediate family. <br /> <br />2. That an appropriate solid six (6) foot wall or fence be constructed <br /> around the entire rear yead area of the property so as to protect <br /> ~. the privacy of the handicapped children and the applicant as well <br /> as that of the adjoining families residing in neighboring <br /> residences. <br /> <br />That C.U.P. %154 be granted personally to the applicant, MATHILDA <br />N. KANE, and that the permit shall not be transferable or assign- <br />able to any other person or party. <br /> <br />That the applicant at all times co~ply with all applicable regu- <br />lations of the State Department of Mental Hygiene, County Welfare <br />Department and City Building Code. <br /> <br />That this C.U.P. ~154 be granted for a period of one year fr(an <br />its effective date, at which time the applicant may request by <br />letter an extension of t/me for a period as determined by the City <br />Council of the City of Santa Ana without applying for a new <br />conditional use permit. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa Ana <br />at its regular meeting held on the 6th day of January, 1964. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
