RESOLUTION 64-6 OVERRULING THE PLANNING <br />COMMISSION AND GRANTING A VARIANCE ON <br />APPLICATION NO. 1842 FILED BY LOUIS EARL <br />AND ALBERTA GONZALES, SUBJECT TO CONDITIONS <br /> <br /> WHEREAS, after hearing on notice, the Planning Commission <br />DENIED a variance on Variance Application No. 1842, filed by <br />LOUIS EARL GONZALES and ALBERTA GONZALES, and Appeal Application <br />No. 105 was duly filed presenting the matter to the City Council; <br />and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that said Variance Application meets the require- <br />ments of Section 9250.8 of the Santa Ana Municipal Code, that the <br />decision of the Planning Commission should be overruled and that <br />said Variance should be granted subject to certain conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Aha does hereby overrule the decision of the <br />Planning Commission and does hereby grant a variance on Variance <br />Application No. 1842 to permit the operation of a drive-in food <br />service establishment in an R-2 District and located at 2328 West <br />McFadden Avenue in the City of Santa Aha, California. Said <br />Variance is granted subject to the following conditions: <br /> <br />1. That a minimum of one covered parking stall be provided for <br /> the residence at 1101 South Golden West Avenue; <br /> <br />2. That development be according to plot plan; <br /> <br />3. That the following conditions are to be complied with prior <br /> to issuance of utilities release by the Building Department: <br /> <br />a. That a 25-foot radius property line spandrel easement <br /> be provided for at the southeast corner of McFadden <br /> Avenue and Golden West Avenue. <br /> NOTE: Dedication shall be initiated by owner, through <br /> the Department of Public Works, at least two <br /> weeks prior to application for a building permit <br /> to avoid delay. <br /> <br />b. That the owner pave between the gutter and the edge of <br /> existing pavement on McFadden Avenue. <br /> <br />c. That the owner place sidewalk on all frontage where <br /> sidewalk does not exist. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Aha at its regular meeting held on the 20th day of January, 1964. <br /> <br />ATTEST: <br /> <br />C~.ERK OF THE COUNCIL <br /> <br />STATE OF CALIFORNIA) <br />COUNTY OF ORANGE ) SS <br />CITY OF SANTA ANA ) <br /> I, DORIS M.
